I-864 Question

Hello,

Ok background first and hopefully someone can help me as my head is spinning and I am pretty sure I am over all of this.

First things first - Our I-130 was approved today, only took 3 business days - YEAH!!!

Now onto the fun part......

I am a USC married to an Aussie citizen - we have three Aussie born children who all also have their US Citizenship. We were married in Australia and have been living here for 13 years. We are now moving back to the US and I am applying so I can bring my husband with me. Now the kids and I are leaving here on November 19th and he will (fingers crossed) be heading over shortly there after.

So onto the sponsor thing -

Obviously I need to fill out the I-864 to sponsor my husband, and I am hoping that I can secure a job rather quickly and be able to do this all on my own. Have I read it correctly that all I need is to have my 2009 tax return (US) and also a pay slip or a letter of employment stating my earnings and I need to earn more then $32,237 per year to qualify. That is based on our family of 5 and if I do not score a job making more then that amount I will need to have a co-sponsor - correct?

So If I have to go the co-sponsor route then my sister who is in the US is willing to help us out. So she is a single parent with 2 kids - so I'm guessing her household size is 3 (as she doesn't have to include my husband?) and her income needs to be $22,887.

Phew!!! I think that is enough. But I am sure I will figure out more as I go. See already thought of one more LOL. Since we are leaving on November 19th and I am pretty sure he will not have filed this form before then do I need to use my US address or still use my Aussie one.

You're right on your income, but wrong on your sisters. As she would be sponsoring your husband she needs to include him in her household count, bringing it to 4 people for her.

For the address... whenever you move you need to file an I-865 to change your address. So if at the time he files the form you have moved back to the US, then put your US address, if you're still in Australia then your Aussie one... remembering that you'll need to file a change of address when you move.

your sister has to include your husband, who is she co-sponsoring then for?

he is also included in her i864.
