once a poet said

i went through so many dificulties that i started to feel every difficulty easir.

we have been throw this ###### so long that now i feel a blood relationship with uscis. divorce is final. they decrree was issued by US supreme court, NY state. How ironic that they denied he previous div by saying that according to mexico law, proxy is not allowed. but we did the same thing in the refiling of divorce. yea as my wife/fiance had moved into japan when they denied her previous div and she had delivred a baby just one month back so it was impossible to fly to usa. we hired a lawyer he presentd the case in the court and it was granted.

so we filed the k-i then.

Meeting Online: Yahoo chartroom Aug 2001.

Direct meeting & marriage: Dec 2003 USA, NY

I-130 petition in DCFR Tokyo: March 14th 2004. Case reffered to DHS USCIS

Four visits to japan in 2004: Oct 2004, wife got pragnant.

Wife/Fiance left USA and moved into Japan: Feb 5th 2005.

Baby Born: June 24th 2005(Japan)

I-130 denied: July 17 2005(Divorce was declared not valid)

Refiling Divorce: oJuly 17th 2005 NY State.

Divorce granted: Nov 17th 2005

K-1 application: Mar 1st 2006

Approval: May 23rd 2006

US consulate RFE: June 15th 2006

FRE sent (Original passports, birth certificate, all origional docs): July 10th 2006

Medical: Oct 11th 2006.

Interview: Nov 10th 2006(expected)

<Lawyers suck. Sorry, if anyone here is a lawyer...But, that profession is losing credibility on a daily basis.> This is so unbelievably true. We hired a immigration lawyer to help us out with this whole process..and as soon as we filed, and paid a nice chunk of change for her assistance, the whole IMBRA fiasco took place, she had the *brilliant* idea to tell my fiance to have me come there (to the US)and we just get married...he had to explain to HER no less..that, that would be illegal..her respose was *yeah it may cause some problems at the border* Gee you think?!

[*]March 24-NOA1

[*]July 17/06 -IMBRA RFE

September 13/06- 3 Emails stating we got NOA2, APPROVED!!! Dated September 8,2006.

[*]October 20th/06-Received Packet 3

[*]October 31/06-Medical Exam

December 6,2006-Interview in Vancouver APPROVED!

Arrived in US- December 14, 2006

January 3,2007- Applied for SSN got within 7 days in the mail.

February 17,2007- MARRIED!

AOS-EAD-AP Journey:

March 2, 2007-Started AOS paperwork

March 12,2007- Filed AOS, EAD, AP Docs.

March 22, 2007-NOA1 for AOS,EAD, AP

March 23, 2007-Receive "Biometrics Appointment"Letter

April 4, 2007- Biometrics Appointment...done..

April 19,2007-Notice in Mail saying transfered to CSC..not sure what is up with that...

May 21, 2007- Touched and email saying case pending at CSC.

May 23,2007-AOS Touched!

May 25, 2007-AOS Touched-Again

May 29, 2007-Email AP APPROVED.

May 29, 2007-EAD touched

May 30,2007-AP and EAD Touched

May 31, 2007-Email stating I-485 Card Production Ordered!!! WOOHOO!

June 1,2007-Email EAD Approved

June 2, 2007- AP Received.

June 4, 2007 -Welcome New Permanent Resident letter received.

June 7, 2007-EAD Card Received..no GC yet..

June 9, 2007-GREEN CARD IN HAND!

Thank you for the clarification. Clearly, you have received a raw deal from the lawyer.

At the end of the day, lawyers are criminals with advanced degrees, and I am no longer sorry for the lawyer bashing. fcukem!!

actually i was replying to william about the mention of mexico,explaining it. that part wasnt in connection to any accusations of racism. As for comment on lawyers, you dont have to tell me they suck. the first unaccepted divorce ranged around $2,000 just to be denied, then to fix it cost another $4,000 from a big city lawyer. we now hired another lawyer to handle our second filing to be sure all goes smoothly. she hasnt done much of anything at all except cost us another $3,500.....total that up to a whopping cha-ching $9,500 plus our our filing fees yet to be added.

Thanks for the sympathy. if you see then we were screwed from everywhere. first the lawyer made us fool. then ###### NY state gave us marriage licence accepting the same div. then immigration took 18 months to declare the div invalidity which could be done in the very first day of our filing.

we have been through this thing too long that now its kinda booring. no more excitation, no more dreams, no more plannings. but if you remmember i mentioned few days back that the best thing we got from this ordeal was that she moved into usa. we got mashallah cute baby.

well i know your fiance is from Indonasia. do let me know what has happened to yoru case. as you remmember your fiance is gonna go through same situation. sending the documents, passports, birth certificate etc. its so misrable when i am treated like crimnal. as you know my all of the docs are in the embassy. i remmember a guy his finace was philpino and ahd been in japan. he had done the same procedure. but he told me that he talked to the consulate and explained that he has come from usa and would like to have an interview before he leaves for usa. they accepted his request, gave his fiance an interview date and there she goes. got accepted in just 14 days since RFE. i have sent my RFEs since last monnth july 10th and on the inquiry we were told "it may take a while"

do i need to tell you what critical reasoning i have to get my visa issued? thats the reason that i mentioned before, benificairy country is too much counted.

I lived in Tokyo for 3 years as an American Diplomat.

Hai nihongo wakarimasu. William san. Watashi ga nihon jin nai. kokoseki ga pakisatn. thats why i mentioned the example of the philipino case. both benificairies were non janenese nationals. one from philipine, one from pakistan. one got her interview date bcz her finace came from usa. while my case is still pending without any solid reason. instead i have given them two very strong reasons. one is the operation of our daughter it has to be done before she gets two and second we are hoping the second baby inshallah in januray. dont you think these are litle bit more important reasons than visiting japan(regarding other philipino case)

Hai, you are in a unique position. However, don't surmise discrimination. I filed 5 + months ago, coupled with a well documented case of State Department employment. Makes zero difference for me either. No favors, no logic, no fairness.

That is why I am so "vocal" in the written word of my complaints of this process. Just be as patient as possible. I have been apart from the love of my life for 385 days+. We lived together for 3 years, under Government scrutiny. Does that help or make a difference? Not at all.

Just hang on for the ride, you will be approved eventually. Regards.

i never wanted an extra favor. all i am looking for is a fair deal. well i remmember when for the first time we went for the DCFR in Tokyo, we were treated like crimnals. And at the end the consular officer told us that we dont say something is fishy but still we never know.

i would love to have an interview with the same guy after three years and would ask hey look thats the fishy thing we have in our relationship. we have been living togather since last 20 months and since then two fish came out of our relatioship. one our daughter one on the way.

gugu76 - CONGRATS! I posted a tread making a parody between the immigration process and the presumption of guilt. In this process, we are basically treaty as guilty until proven innocent, which is really my weird way of observing this process. Some did not agree and basically thought I was out of my mind because this process is about eligibility. I can somewhat safely write that you may agree with my position. Not with being out of my mind (LOL). Well maybe you will... (LOL) BUT what I meant is my interpretation and analogy of being presumed guilty. Cheers!
