Yup, i'm a K1 visa holder. So... Udella&Wiz you say I can just go and apply for a SSN? I am just now working on getting my forms filled out to send out my AOS, so I have not yet filed my Employment Authorization form. Would I still send the I-765 with my AOS package? I was told to get my US licence I need a social security number. Would I have my SSN, be able to get my licence, but not be able to work until my I-765 were approved?

I am not exactly sure of this so dont take my word for it, but I think people have had a lot of problems the longer you wait to do, ie the closer the i-94 is to expiring. I am not sure as I am a cr-1 and well as you can tell I asked the main question hehe so I dont know too much myself.

Also I am not sure if you are already married if that makes a difference or not. someone with more experience will surely know :)

Somewhere along the line you have some confusion regarding the realtionship between EAD and getting your SSN - many of us K1's have gone within a couple weeks to a month after arriving to get our SSN - filing our AOS pkg is an entirely separate event. As Canadiangal mentioned - they will not issue your SSN if you're very close to your I94 expiring though -but that has nothing to do with having filed your AOS (including EAD).

The requirements for license (you mean driver's I assume?) differ by state(which may include SSN) but that doesn't really figure into this discussion.

Try a quick search in the forums on applying for SSN.

You need to apply for your SSN within 76 days of entry as they will not issue one within two weeks of your I-94 expiry date.

Yes, you'll need to fill out your EAD form as you cannot work without it or your GC. You'll need to check the identification requirements for whichever State you're in as they're all different, but usually you'll need at least an EAD or a NOA. (I-797C)

Yeah, I was wondering the same. I actually already have an SSN from a previous J1 visa, so I'll really just be looking to change my name after our wedding...... but I assumed I checked "YES" on DS-230?? Why isn't that a good idea.....?

Only works for people with immigrant visa, so as a K-1 it wouldn't have worked even if you did check off on the DS-230.

hey guys,

I just crossed the border yesterday but am curious how long I have to wait to apply for my SSN. On my ds230 I checked No to the SSN as I had seen some long wait periods and even some horror stories. Also what do I say?? Is there anything special? I saw somewhere about mentioning a certain system but I am not sure what it is?

Since you didn't check off on the DS-230 you really don't need to to wait any time at all. Now since you don't have an I-94, I'm not sure if it would be smart to wait the 10 days SSA advises people with nonimmigrant visas to wait, but it couldn't hurt. Plus since you have an immigrant visa, don't be surprised if the office tells you to wait three weeks. That is the amount of time you need to wait when you do check off on the DS-230 and the office might not take your word that you didn't check off on the DS-230. They want to make sure people aren't assigned two SSNs.

They say to wait 10- 14 BUSINESS days.

It's ten calendar days, but it's not really necessary if the person at the SSA office knows what they are doing.
