Friend sent for ROC without any evidence

A friend just called me to ask about ROC - they sent it off in Aug/Sept and received the NOA1. What they haven't sent is any evidence!!!! It seems that all they sent was I-751, check for required amount and the copy of GC of her husband.

I belive RFE is imminent and told her to get all the paperwork in order so when RFE does come they can send it back ASAP.

Anyone heard of this happening and what was the hold-up in approval (if any).

And all this after I emailed them months ahead of time with a copy of cover sheet and evidence we sent in :o

Yikes! :help:

Well I would guess an RFE is guaranteed in this case. For sure it will slow things down to some degree but if they are prepared with solid evidence and send it out asap following the RFE the case should proceed normally from there and hopefully work out.

Good luck to your friend.

Well, this just happened to me..In July I hired an attorney to assist me since I was removing conditions with a divorce waiver..I signed the I-751 and all he told me was to give him any paperwork I have to proof that I shared the residence with my USC x-wife. Well, I gathered 2-3 bills in my name only showing the address we shared, 3 affidavits and a couple of bank statements from our old joint account and handed to my attorney. ..I should have known better!! LOL!!

Well, sure enough I received a RFE which listed all the documents I need to send in. It was very hard to compile the documents since I moved out and most of the bills in our name have been changed to her name only and most companies dont keep records for more than 12 months.

I just mailed all the documents I was able to gather on October 26th and the package was delivered on Oct 27th.

My status online has never been touched since the initial statement "On July 21, 2010, we received this CRI89 PETITION TO REMOVE CONDITIONS OF PERMANENT RESIDENT STATUS RECEIVED, and mailed you a notice describing how we will process your case...."

Waiting and hoping.....

Do they have a good reason as to why they sent an envelope without any evidence?

Were they within the last couple of days before GC expiration and they had no time to gather evidence?

I think they were getting ready for a trip overseas and just forgot to send in the evidence collected - not much of an excuse but that's what it was. I don't think it was sent in the last couple of days prior to GC expiration as they were able to travel and return to the US and NOA was waiting for them upon return.

I'll tell her to be on the lookout for RFE - she has everything ready now.
