Good day... My Mom or Dad Will submit An application on December 21 for their son who is 14. I'd like know if it matter which of the parent submit the I-130. Their Names have been on his Birth Certificate since birth.

Is it true that a DNA test may be requested if the Dad submits the Application..?

Thank you.

Based on what has happened with others, I would say yes, it is possible that you could get hit with a DNA test - in my opinion, I would have the mother petition - No question as to DNA there!

Good thing for now is the fact tht for an LPR petitioning the child it is 9-12 months. In 2007 ( son was 18 at the time of filing ) it was 4-5 years :) Good luck with the process. Just FYI my husband the DAD petitioned his son born out of wedlock, had a bit of a problem at NVC but got through and luckly no DNA requested and he is here :)

Why is it that the only one who can stop the crying is the one who started it in the first place?

In Kingston, a DNA test is usually required if the father's name was added after the initial birth certificate was issued. The only other case is if the child does not favor the father. My friend filed for his son. My friend is brown (light skinned). His son has the mother's complexion (chocolate). The Embassy made him take a DNA test. Of course, the pickney belong to 'im!
