US Domestic Air Travel after 180 days AOS sent

Hi,

Thank you in advance for your replies, help, and information! My husband arrived on a K1 on 05/26/2010. We married 06/09/2010. We are going to fly (to Orlando, FL - Disney World) just slightly after 180 days of his arrival (after Thanksgiving). His I-94 is expired. Even if it is "assumed" he is ok by anybody checking his passport because he is from a VWP country, he is past 180 days (I don't mean to confuse anybody with this thought about the VWP since he arrived on a K1 visa - just read it on another forum that nobody will even check his passport for Visas, etc.)

If we carry our NOA (assuming we receive it within 25 days of submitting our AOS today)- will we be ok? Does anybody have any knowledge of what the airlines & TSA will be looking for? I had plans of submitting our AOS as soon as possible, within a month of the wedding, but that just didn't happen due to multiple reasons. We are mailing our AOS priority mail with delivery confirmation today!

It won't be an issue at all. Since it is domestic travel only, it won't matter one bit.

TSA should only be checking to make sure he matches his passport photo, and his passport matches his boarding passes. They are not trained or mandated to evaluate legal presence. In the worst case scenario, they would escort you to Immigration. If you have the AOS NOA1 and expired K-1 I-94, even that million-to-one shot shouldn't be any problem, as you'll be able to show Immigration hsi current status.

If you're worried about it, you might want to arrive at the airport an hour or so early, just in case, but as I said, it's a million-to-one shot that TSA would even notice. I'd be more worried about there being a fire in the terminal building. The odds are higher.

What's really important in order to avoid problems are these things:

1) No terrorist Halloween costumes on board

2) No guns, neither real nor fake.

3) No screaming of the words "terrorist" or "bomb" while on board

4) No knife fights at all, no fist fights with flight attendants

Other than that, I can't think of any other problems.

When you go through screening just make sure that you follow the regulations as relates to what you can and cant carry onboard. Remember the TSA has the new patdowns that are quite invasive so be prepared for that (If there is no full body scanner at the airport)

Other than that TSA arent trained to look for immigration violators.

Some posters are offering rather cavalier advice. Yes, the chances of trouble are typically remote, but always be prepared for the worst.

Keep your MOST RECENT PAPERWORK with you at all times. This means your NOA1 (if received); or a copy of your cover letter to USCIS for AOS, ideally with a copy of the check for payment; and a copy of your marriage certificate.

CBP/ICE agents sometimes hang out with TSA in airports. No inkling of a sense of humor is anywhere to be found. The Federal government has unlimited time and resources to make our lives miserable. Bring all possible documentation and minimize the chance of that.

Thank you everyone for replying. I plan on getting to the airport early - I always do just to avoid getting stuck in security. We probably will get there about 1.5 - 2 hours early. I expect it to go smoothly, but will be prepared with a copy of our AOS submission (with copy of check, etc) in our carry-on, as well as any received NOA or other paperwork that we receive (copy of cancelled check, too, perhaps).

I wasn't aware that neither the Airlines (flying Southwest) nor TSA agents would not check for status. I guess it would be rather difficult, requiring advanced training in immigration law, etc.
