Hi i have a prima facie case. i also have a extreme cruelty judgement vs my wife. we had a dual judgement, she got irrconciable difference and i got extreme cruelty. i have the court papers. My lawyer said that I have a prima facie, as some confirmation sent by the VT center. recently i have finally been single, free and now I am divorced. I have been dating and finally having sex again. But as of recent I am under one of the largest scares in my life, a partner i had been dating and recently having sex( After my divorce) with had admitted to me they had herpes type 2. I am very worried i may have contracted this disease from them. I am getting check as soon as possible.

My main Question is will this be a basis for rejection? they do biometrics and stuff and that is based off medical i guess? along timne ago i heard they deny people with hiv or really serious diseases. So i am VERY worried now and also sad and afraid. I finally have freedom from my abusive spouse, i get to enjoy sex again with someone i thought i could trust and this happens and worse yet im afraid it would affect my ability to get a full approval?

I have not been sent any RFE's from VTC i have a good case and put all my evidence afidavits and alot of evidence and all the requirements. when they do medical they want to know if you have any diseases right? will this affect me if it turns out i have ocntracted HSV from someone? I dont know what to do anymore. I hope to God that i do not have the virus and that someone can help me with an answer about this subject, it is stressing me out. i have been doing searches but I probably not thinking straight with this issue.

What is your VAWA claim for? Removing conditions, or adjustment of status? A medical is not required for removal of conditions, but IS required for adjustment of status.

Herpes is not classified by the CDC as a communicable disease of Public Health Significance. You won't fail an immigration medical for it.

The biometrics appointment is not a medical exam - it's photos and fingerprints; your biometric identifiers.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

i applied for i 360 and im going for adjustment of status under vawa as battered spouse, my lawyer says i have a prima facie case and it sounds good as they dont have any rfe's im awaiting a response on what next to do. I have gone through hell with my wife and back and have had the documentation to prove it.

Thankyou for your response! this brings me alot of relief. I am very serious. I actually cried at the idea that this might prevent me from being able to adjust my status. Thankyou!
