"Have you ever been to the US?" application question.

Hi everyone.

My fiance wants to answer "No" to the question on the application, "Have you ever been to the US?" Where in fact, she has been to the US.

She has a new passport, and lost her old one with the visa stamps. She thinks answering Yes, will cause MORE questions to be asked, and she does not want to answer more questions, for various reasons and different circumstances. She thinks that answering No will just be ok, and they will not ask anymore questions.

Am I right in thinking that this is a huge question that should not be lied about?

Do they have access to old records saying she was in the US?

Never EVER lie. They may ask no questions, but saying no would be misrepresentation, which leads to a lifetime ban. Then she'll only be able to say "I have never been to the US again".

added: oh, and yeah they do have access to old records, because everything is computerized.

Agreed, it's a headache to figure out each and every trip to the US, if you've made a lot of trips..... but do it anyway! I just spent an hour or so yesterday figuring out exact dates of my trips to the US, including day trips my family took in the early 90's. I just made an excel spread sheet so I can copy & paste the data into other forms in the future. Your fiancee can do something similar, so she never has to figure out the info again, since it'll be saved.

Tell her to deal with the headache now, rather than a WAY bigger headache, later.

Do not lie. Stop thinking so much and answer the questions. Unless she was robbing banks while here, what's the problem?

People that live in border areas often make frequent trips to neighboring countries, It would be impossibe for me to count my visits to Canada in the last year, let alone in a lifetime. The last month may be feasible. I would mention "long visits" (overnight for example) and then write "multiple short, single day visits" I go there for lunch sometimes. Great Viande Feu!

Don't EVER lie. That's one of the worst things you can do while you're in this process.

I had a similar problem where I couldn't recall all the dates I had crossed into the US, so I wrote down the dates I could remember then stated that, ''There may be trips that occured which I do not remember, and I've been crossing the border since childhood.'' They accepted this and everything went smoothly. I was asked about a few visits though at my interview, some I said I honestly didn't remember and another was Disneyland...and I still got approved, just be 100% honest.

Do not lie. Write "yes." As simple as that. Always be truthful answering the questions asked. Wouldn't it be horrible for your petition to be denied over something as silly as lying on this question?

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.
