K1 visa without a passport

I need some guidance. I am a US citizen who filed a 129F for my fiancée who now lives in Montreal, Canada. She’s originally from Congo but has a temporary resident status in Canada.

She got her temporary resident status thru asylum but she hasn’t done the formal interview yet. It’s been a year already since she has been waiting for the interview but I was told it’s been taking up to 2 years.

Bottom line is I think her K1 process will be done before her Asylum interview. The Canadian immigration is holding her passport until the Asylum interview.

My question is. Since she is in Canada and don’t have to fly to the US. Is there an alternative to get permission to enter the US without holding a passport? I just wanna know if I am gonna get stuck once everything is sent to the consulate in Canada or there is something else she can use to gain access to a port of entry?

Please help!

Interesting situation, she'll need her passport once she gets to the interview. Not sure how you can get around that. Try contacting the Montreal consulate to see if there is anything they can do

Good luck

?Definitely will need the passport. Is she still wanting to go through with both processes? Or just the K-1?

The K1 is a visa stamp that's attached to a page in the passport. There is no way to get a K1 visa without a passport. I don't know the laws in Canada, but I would presume that asking for her passport to be returned would probably terminate her asylum application, which I suppose might result in her being booted out of Canada.

Maybe you can have her contact the Congolese embassy in Ottawa and see if she can get a replacement passport.

There is a way to cross the border without a passport if you are only driving. My husband has it. It basically a drivers license "plus" or something along those lines. Have her check the SAAQ website to check the details. It is only valid for US - Canada crossing. I don't know all the exact details but you should be able to find it on the website.

Hope that helps!
