Hello Everyone,

Yesterday evening, my co-sponsor let me know she brought over their husband to the US in 1986. My spidey sense went off when she told me she didn't have to file an affidavit of support for him. She claimed her father did it. Is there any way to verify if this could be true through the USCIS? I know that he is a citizen/permanent resident (will check today) now, but they can't remember the process for the life of them...

Any ideas guys? Definitely would love to avoid filling out the Q 21. Letter F incorrectly.. If it even is a big deal.. :)

For sure you don't wanna write any misleading information so you make sure she tells you exactly if she sponsored him or not

If everything fails and she can't remember for sure, call NVC and tell them the situation and they will give you the best advice.

Sponsor's obligations under a Form I-864 will end if the person who becomes a permanent resident based on a Form I-864 that you signed:

2) Has worked, or can be credited with, 40 quarters of coverage under the Social Security Act;

3) No longer has lawful permanent resident status, and has departed the United States;

4) Becomes subject to removal, but applies for and obtains in removal proceedings a new grant of adjustment of status,based on a new affidavit of support, if one is required; or

5) Dies.

Note that divorce does not terminate your obligations under this Form I-864.

There was something you signed back then about support but it was nothing like the current form. They didn't want copies of W2 or anything. But If the hubby has worked since then they hit the 40 quarters long long ago.

Thank you LOTO. I always speak with an operator but they only say that I have to wait because there are millions of cases. I was told that because I am petitioning my husband and I'm a USCitizen it was faster. But I see that the interview dates are already on March. This is so hard!!

The number I gave you is different. It is not regular NVC number. You will get clear picture when you call at that number.

Are you USC petitioner or LPR petitioner? Or your consulate is busy scheduling interviews?
