I think there could be a problem since the woman is much older than the man. This is definitively, not the norm. It is just my opinion.

I am almost 12yrs older then my husband and we had no issues at all regarding age difference.

Well, age difference and how concerned they are depends not only on the consulate doing the interviewing, but also the nationalities of the people involved. What I mean is that if it's a UK citizen (born & raised, from a western family etc) then experience shows, (as directly above) no problem. But, if the beneficiary is from a high fraud country and in the UK on a visa or from a culture where this is out of the norm, then this could lead to some questions. It's not a deal breaker, but could be trouble, the OP has to understand the potential red flag and then assess if it applies to their situation, then prepare accordingly. It is not strictly correct to say "Oh, UK, no problem" that statement assumes some background on the part of the beneficiary/petitioner which may not be true.

Regarding the timeline of the divorce and the petition - At the time of FILING the petition, both parties must be free to marry. Others have gotten caught up by divorces not being finalized at the time of filing (they hoped it would be cleared up in time for the interview) and there were issues, so safest bet would be to understand the waiting period (if any), when it starts, when it ends, and then file after that time.

Hello everyone.

I got a double issue and was hoping to get some information so I can sleep eaiser. Thank you in advance for any information.

1. Age Difference: I am 25 & my fiancee (who is female/US citizen) is 33. Should I be worried about this? Anyone think I will encounter problems during K1 process?

2. We are not going to file for the K1 Visa for at least another 6 months, but my fiancee has been divorced for only three months at present. Will this be problematic?

The key thing would be to make sure that your fiancee's divorce is official and final before she files the petition. Make sure that she has the signed copy of the divorce decree (signed by the judge) with a final divorce date that is prior to her filing the petition. The age difference is not huge and there are plenty of petitioners who have been previously married. You should be okay.

On a different note, why wait 6 months to file? If you do not mind waiting longer, you could go ahead and get married in the UK and then she could file for you as her spouse and you would be able to enter the country as a permanent resident and be able to work right away.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

Once both parties are legally and willing to marry within 90days. Large age gaps like 20yrs is a red flag not only in high risk consulates like Lagos,Manila,philippines and some other African countries but in other consulates too. So u should be fine. As for the divorce, once you're free to marry with evidence of divorce decree, then there shouldn't be a problem.

I'm on this a bit late, but just in case rockytails returns, I'm 35 and my husband (the one w/the English accent) is 28. We sailed through K-1 and AOS, and the age difference was never brought up, not once. Good luck!
