My income has for the past 2.5 years been above the current poverty guidelines. Will it hurts my CR-1 if 2007 income was below current guidelines? Can I provide child support payments, as well, as non-earned income?

Hello. The 2009 income is what they will mostly be basing your approval of I-864 on. the other years are optional and it shouldn't hurt you. :thumbs: You can add whatever you wish but NVC should just pass your file along. If you feel you need it, you can always take it to the interview at the Embassy.

-POE FLL- 1/23/11 YES! BUTTTTTTT....still not reunited :'( (Reunited on the 24th)

CURRENT income and evidence of future substantial income is Numero Uno.

My most recent and current income is all they looked at. Prior years were below required. NO problems as my wife made it thru the whole embassy, AOS and US citizenship process. She's voting nxt week!!! :dance:

Yes you can use your child support in Morocco. I had to call the Child Support Agency in my hometown and have this information sent to me as proof of income. Also, any direct deposits into your account. If you are paid by cash then this could be an issue proving and also using it on your I864 form. We were approved, so have it all ready and you should be okay.

I think you dont need to do all this process. If your last year 2009 income is sufficient means it is above the poverty line then you are fine. They focus only on last year income and current year income.As above said by other members is correct.Even you can see in the I-864 form that to send tax returns of second and third most recent tax years is OPTIONAL. But i suggest you if u have them then send it rather than being worried about it.

I would like to mention, you do have to show your child support under income. I had to add alimony, child support and part time job and IT STATES on the I-864 to add this even thou alimony is not counted, I still had to show it on the I-864 because it is INCOME. You will need to put the child support under income and good for you it will make your income even look better since you are over the guidelines.

Are you saying she does not have to include her child support as INCOME on the I-864 even thou she meets the poverty guidelines without it?

My husband is currently looking for a full time position (he was working up until mid-August and has had temporary work since then.) Let's say, optimistically, he finds work next month (about the time when our file, (hopefully, please, please, please, please, please) goes on to NVC, will the fact that he's been out of work and just started a new job work against us? I should add that he's already made above the poverty line for this year and last year he worked steadily and was above the poverty line as well...

Thank you all for your comments. I am a little nervous because I need to be sure that they will not look at "net income" I am NOT self employeed. Will they only look at my AGI or total gross on my 1040? Please advise. I am getting scared! My total gross on the 1040 is above, but my net pays for 2010, so far is below. Even with my child support and my net, I am not above the poverty guideline. Please help!

Min. Household size will be 2 - because the petitioner (sponsor) and the beneficiary (intending immigrant) is always included.

Assuming you have a household of 2 and live in the main land of the U.S and you are not in the U.S Armed forces, poverty line for household of 2 is $18,212

If you work full time (40 hours a week), you will have around 2,000 hours in a year. 2,000 hours multiplied by $11 per hour is $22,000 which is good.
