Good afternoon or evening or morning everybody. I guess it just depends on where you are in the world. Just to give you guys a little background knowledge, my wife who is ethiopian was denied a non immigrant visa on July 29th 2010 everything was sent back to USCIS and because I am in the military I was able to get them to expedite my review and I then received a NOID. (uuuhhhgg) sick in the stomach, because wifey and I have spent so much time away from each other over the last 2 1/2 years, Im just ready to settle down and have some babies but we both want to be stable. Anyway, I sent additional evidence which included my SGLI with her on it, my Page 2 with her on it (military dependent form), pictures(dating, wedding, and current) testimonys from friends who knew us when we first met, western union receipts going back to 2008, phone and skype records, work evaluations from the time period when we first met proving I was stationed where I said I was, copies of my passport showing I had been to ethiopia 3 times in the last 1 1/2, and the kitchen sink. They received all of this info on September 29th 2010, and here it is October 29th and still no mail reply. I am believing GOD for a successful rebuttal, and so is my wife. Does anyone know or have experience with the amount of time its taking USCIS to respond to a NOID once they receive the evidence. I know the paperwork says 60 days but do they generally take all 60 days, or is it more like 45 or 50. I know all of you have had the same or longer journeys than mine. Your input is welcomed and would be an absolute blessing. Thanks everybody and take care.

Also, since you are in the military google AILA (american immigration lawyers association) and then search the site for the Military Assistance Program they run pro-bono. They might ask you to fill out a form but follow up in a couple days to make sure they get back to you.

Hopefully this will turn around, but these issues seem to be tricky and you might need some help.

Just caught that, she is your wife why the "non-immigrant VISA" ? What did you apply for?

Did they lay out what evidence they wanted or reason for the notice of intent to deny or did they just recite what the consular said?

Yeah they just laid out what the consular said. One big issue they had was that my most recent trip to ethiopia was when we got married and my taxable earnings for that year was about 9000 dollars, but that was because I was in a tax free zone, and I made much more money than that, so I sent them my W-2 detailing that, also I got married to her only 8 months after my first marriage ended, but my ex -spouse and I had been legally seperated since 2006. I sent them legal documentation of that. Plus my wife even though we have been together for almost 3 years and married for close to a year now has never been to the U.S. she got confused on a few questions like where I went to college, what branch of the service I was in, and my mothers name, I know it looked questionable to the officer, but my thoughts were not to inundate her with a bunch of info that she has no real concept of. She grew up in a remote part of ethiopia till she was 15, and moved to addis ababa shortly there after, she has no real concept of life in the u.s let alone the u.s military. I think this was a mistake on my part, so I have since made videos detailing every factor of my life including my ex wifes name, schools and family as well as work info and she has over the last 3 months really gotten familiar with everything, despite her english being marginal, but I love her and we can work through all that mess we just need a chance. I know me and I know her we are good together. They didnt reallly say what they wanted to see in the way of evidence so I sent them everything I could think of.

In the higher fraud areas they really ask any question they can think of to deny a person. In our first pass at a K1 the CO asked for details of what I do in my office. The problem is I have a classified job. But still that was the reason they denied the petition. After dealing with that through the security rep at work and refiling did we get approved. Some consulates are just crazy when it comes to interviews

This will not be over quickly. You will not enjoy this.

I am seeing that. I know alot of guys who marry japanese girls or have married japanese girls here in hawaii, and they say oh dont worry that interview is a breeze but I know that the fraud is high in ethiopia because people are much more desperate to get out, I figured that was why they asked so many off the wall questions, but we could have prepared a little better I think it was on us to. Anyway God is good, all the time. Nigeria or Bust did you respond to a NOID or did they even give you the chance to do so, and if you did what evidence did you provide and how long did it take for them to make a decision.

Hi, everyone - I just put together a petition to Hillary Clinton, and the heads of FBI and USCIS to reform this entire process, including allowing appeals of denials so people don't have to pay all the fees again, time limits on administrative processing delays, etc. I also said they should appoint a commission to assess the process from top to bottom, and make recommendations that would cut processing times to an average of six months instead of one year, and also address questions of de facto racism (such as not setting a higher bar for Africans because of an assumption that since their countries are poor they will overstay their visa or be more likely to commit fraud.) Please sign it if you feel you can. It may not do any good, but you never know:

I filed an attempted espionage report through work to the DOD and then refiled a new K1 using presumption of expiration on the first one as cause. They accepted the second petition and expired the first a few months later. On the second interview their silly questions included " did your father die because you are marrying a white woman ?" and "What do her deceased parents do " ( He responded they do what people in heaven do )

This will not be over quickly. You will not enjoy this.
