If you have the transcripts you don't actually need the W2's at all. He definitely needs taxes for the most recent year but sometimes they require the past 3 years.

Someone from who went through the same embassy you are going through would probably have the best answer.

Although I have found that if you are borderline meeting the poverty guidelines they may check the other returns, but if you clearly have enough then they won't.

Does anyone know under what circumstances he would need 3 years worth of tax transcripts?

Rather than making this a guessing game please state the circumstances.

3 years of tax returns are not required. The VJ guides suggest 3 years of tax returns. Not all petitioners have filed returns for the most recent 3 years.

In 2 years on VJ, I have never read an interview review from Montreal where the CO asked for 3 years of tax transcripts. I have read more than 1 review where the beneficiary wasn't asked for tax returns at all. With that said, many (if not most) are asked for the most recent years tax return which would be for 2009, including myself. I would definitely come prepared with that. As another poster said, if you get the tax transcript from the IRS, there is no need to bring W2's.
