hi guys i would like to know if i can get an ss number for my kids coz when we went to social security this afternoon the guy told me that he cannot give an ss number for my kids unless they have a work permit how i was wonndering why he was telling me that since my kids are minor and in the first place no way to get a work permit other than they reach 16 my question is, is it really true that they cant issue an ssn for kids since my fiance soon to be my husband on sat. will add on his tax as dependent.anyone here have the idea thanks and Godbless:D

From the information available on the SSA website K2 holders are not eligible. K1 visa holders are eligible.

The Social Security Administration can issue a Social Security number to a K1 visa holder, provided they submit the application at least a couple of weeks before their I-94 expires. They can't issue a Social Security number to a K2 visa holder on the same basis, though. Someone who entered with a K2 visa will need either an Employment Authorization Document (EAD) or a green card to get a Social Security number.

As far as I know, there is no age limit on getting an EAD. Technically, a K2 can apply for an EAD before their I-94 expires, just as a K1 can, but it would only be valid until the I-94 expires. Further, unless you apply the day you step off the plane, there's a pretty good chance the EAD would be expired by the time you received it. For this reason, most people don't bother to apply for the EAD at this time.

You can also apply for the EAD at the same time you apply for the green card (after you're married). An EAD issued on this basis will be good for one year, or until the green card is issued. There's no guarantee you'll get the EAD before you get the green card, though.

An EAD is sometimes referred to as a "work permit", but I think you may be referring to a state issued work permit. These are required in most states for minors to be allowed to work while they are still young enough to be required to be in school. A state issued work permit is not required to get a Social Security card.

Submit your AOS applications soon after you get married and you should get your green cards in time to get Social Security numbers for your kids before the tax filing deadline next April.

I should have mentioned...

I'm no tax expert, but I think there's a pretty good chance your husband will not be able to claim your children as dependents on his 2010 tax return. There are a variety of requirements, but one is that the dependent must have been a citizen or legal permanent resident for some portion of the year. If I'm wrong about this then I'm sure someone with more knowledge will come along and correct me. :blush:
