Finally Granted Approval(in conjuction with I-751)

I am so relieved that my N400 is already approved today. I had been waiting for this day to come. I have no clue that today will be my final interview for N400. The letter that was sent to me was for the I-751 application. You might wonder what does it have to do with i-751. It is because of some erroneous mistake made by some people.

I had applied N400 April and I got my interview middle week of June. I passed the written and Us history test but there was no approval that has been made. During the interview, I just found out that I was single for 2 years. I asked the officer why. Somehow I did some explanation that it might have something to do with my current GC.

For you to know - The story started from my AOS year 2006. I was granted 10 years right away. With my delight I was thinking oh yes this could save some money to remove conditional status. Not knowing how the consequences could lead to this day. Anyway, with a 10 year GC in my hand I started noticing I got problems with it every time I re-enter the country when I travel. The immigration officer at the airport would always tell me that there is something wrong with my greencard. I got no clue what it is all about since I have no information of their system and what my card reads. From the time I got the 2nd person told me the same thing at the airport, I went to the nearest local USCIS. I had my interview and they requested me to apply for I-90 to correct my status. So I did, after 7 months I got the new greencard. But recalling the inscription of the card it still looks the same as the previous card. Granted that I apply to correct it and having the same expiration date, I didn't apply for I-751. I already have a welcome notice for LPR. So in my mind why do I?

So back in June of this year the officer reviewed all the documents I submitted that I applied for over the years and there was no mistake at my end. It was recognized too that it wasn't my fault why I didn't apply for 1-751. I asked the officer that time what the time frame could be like and if this could be resolved. I was informed there could be no definite time frame. It will be fixed and, the last phrase I heard "this is a rare case". I asked another question as to how long do I have to wait until I can get any instructions from the local office. I was told 2 weeks. Which it took over than that and I was requested to apply for I-751.

I submitted it a week after I got the notice and after 5 days it was sent back to me. Now what??? Then the letter said, we can't process your case if you will not send the original GC. So I did which I uncomfortably have no choice. It was a quick though that after 4 days they sent me the extension letter but no greencard. After 10 days or so the GC was sent back. I was glad. From then on I have no news until Oct 15th I called the customer service to check the status of my case. I was then told the letter was sent to you this week for an interview on the 28th. and the appointment letter for 1-751 was in the mail the day after I called.

Today is just lucky for me because it could mean no more waiting if one application has been approved or not but both is already been approved. Now the oath taking ceremony awaits. I hope it will be next month since the officer told me that there's always ceremony every month in one of the city here in San Jose CA. Just one information though that I know from the interviewing officer. My case is fortunate because the director of the local office made clear that my case is not fraud and my N400 wasn't dismissed. Apart from that, I was shared an information that there was also one case who is similar than mine but the N400 was denied. The person has to wait the I-751 is been processed and approved and re-apply and pay again the fees. Now I can say I am lucky. Hopefully this will be the last obstacle.

July 24, 2010 - package sent back requesting for Original GC

July 26, 2010 - resend package

July 27, 2010 - check cashed

July 31, 2010 - received 1 year extension

August 13, 2010 - received GC in mail

October 28, 2010 - approved with no biometrics and doesn't have to wait for the new GC

There is no timeline detailing when you got married and when you received your green card, but if you had been married less than 2 years at the time your were granted the green card that would be a good indication to you that you should've received a 2-year card and lift the conditions, never mind what the card mailer or the card said.

This is why I always recommend to anyone who gets a 10-year card when in fact they should get the 2-year card to correct the issue with the USCIS and file I-751 - so something like this does not happen down the road when it's time to naturalize.

I applied AOS Oct 2005 and approved with GC Feb 2006... You are right that anyone who receives a 10 year GC during AOS should apply to correct it of which I did the very same year I got it. If I could have not applied to correct it I could be one of those unfortunate to be denied with N400. But because I had proof that I had applied for it, my naturalization was approved.
