Hello Again,

I have finally found out about the I-601 receipt status (previously mentioned in another thread by me) finally.

Today I was able to get through to a very helpful Tier 2 person at USCIS. I explained to him that I did not get a receipt # for the I-601 subsequent to the application arriving at USCIS Vermont. The gentleman was able to verbally provide this number to me.

My previous thread was about being "Touched"(which I was not, perhaps because I was using the I-130 receipt number) in respect of an I-601 application. So, today I entered my new found receipt number into "Online Status" to find out a notice was sent to me saying the I-601 was accepted and will explain how the case will be processed. I have not to this day received that notice. This was sent on May 21, 2010. Also, I noticed that I was "Touched" (lol) on July 10, 2010. This is the latest info I have however the gentleman said the application was in "processing" so I asked the timing to complete the 601. He said between 3 and 27 months. So, I am almost at 6 months since receipt at USCIS Vermont and NOW, I finally have some feeling of comfort (of course being the optimist and ignoring 6 months to 27 months)that soon we will prevail.

Now, just wanted to let you folks know that it IS possible to get this receipt number through a Tier 2 person. I have read that a few others were having the same difficulty as I.

Well I know this was really bugging you so I am glad you got it sorted out. I am sure there is some relief in seeing the case number in the computer and at least being able to be certain Vermont has your application somewhere in the que. Hopefully it will not be much longer before you hear a YES your waiver was approved !

Just to clarify for anyone reading this post, ONLY I601 CASES THAT ARE BEING ADJUDICATED IN THE STATES WILL HAVE ONLINE ACCESS that Davey is speaking of in terms of being able to log on and look up the case number to verify reciept.

If the I601 was being adjudicated overseas (and the vast majority are) you will not be able to view case status on line like Davey is.

However, there a few Embassies with USCIS posts that actually make up a spreadsheet that has the case numbers and various different bits of information like "pending" "approved" "waiting for adjudication" ..the few I can think of are I believe London, Athens and ... maybe Panama or Honduras? (I am sure someone will chime in to add the others)

Again Davey, hope your processing goes quickly and has a positive outcome ;)

Princess, you are quite welcome. Hang in there!

Just a bit of advice. I had a completed 601 at my interview and was not asked for it. My gut said to present it however I was advised not to, unless asked. Hindsight right? Three months later I was asked to submit the 601. I see no harm in presenting it at the interview regardless just in case. Perhaps some other VJ members can offer an opinion on this.

Good luck with the process! I agree, it is not any easy road but LOVE helps us prevail.

Davey is 100% correct, if you know for sure you will need a I601 when you go to the interview do not get caught up in hoping and praying maybe they will make a mistake and hand your spouse/fiance a VISA.. it doesn't happen that way. In Davey's case they made an error, technically they don't really need one.. but that is a different post ;)

Anyway if you have it prepared, bring it with you and insist they take it, or schedule a day for you to return with it.

I saw your posts in another area. It looks like you have already been through the process once, had to get married and then start over because apparently the consulate told you that the issue your husband needs a waiver can only be waived on a spouse VISA not a fiance VISA.

This one is a new one for me, and it also worries me that you said you cannot afford a lawyer.

You should start a thread and start asking folks to start researching what the charge was, what the criminal code is and IF there is a waiver available for that issue.

What codes did the consular write down on the denial of the VISA paperwork he gave to your husband/fiance?

At the risk of hi-jacking Davey's thread, I will answer your questions here.

Yes, we will need a waiver for sure...

I really don't know if we can be approved for it, but I have to try.

It may be possible for me to obtain a lawyer for the waiver portion of this next round, and I am working on it.

My husband has 2 charges for possession of marijuana. :( yes, I have read the law, I know it says only 1 charge for simple possession can be waived... but the amount of pot was so minimal that it amounted to less than $10 US dollars in fines and no jail time. He was young, unmarried, and had no children. He meets the 3 year sobriety requirement, is now married and we have a daughter. I have a very strong case for hardship, and a son of a USC who cannot relocate to Jamaica. I have researched this stuff until I am blue in the face, and to me, if the true purpose of a waiver is to weigh the severity of the crime against the hardship to the USC then it is obvious he should be approved. I just don't know if the law will see it that way.

The letter to my congressman from the embassy says:

As an applicant for a fiance (K1) visa, Mr. Princess cannot apply for a waiver of these ineligibilities.

Under INA 212(i), a waiver of 212(a)(2)(A)(i)(II) and 212(a)(2)(B) ineligibilities is available only to the spouse, son or daughter of a U.S. citizen or legal permanent resident.

No thoughts on my situation brokenfamily?? :unsure:

I filled out an intake form for a consultation with a lawyer.

The form said that one must be eligible for a waiver in order to qualify for the consultation.

They just called and said that we qualify for the consultation! :star:

I know it's not much, but it gives me a little hope...

Maybe this is possible (F)

Now, does anybody got a couple grand I can borrow?? :rofl::crying:

I didn't see the post until now. I am not familiar with the drug use crime statutes, but if you have the charging documents what I would

do is look up the charge in the country where it was committed and find out what the maximum sentence for that type of crime was, and have that available for the lawyer so you don't waste your first visit "getting to know each other" and not be able to get any firm answers on your eligibility because he/she will have to go back and do "research" on the crime.

As a general rule and tip for any interaction with the attorney since most of them bill by the hour, do as much legwork and research as you can

and always have a list in hand of the issues you need to discuss so you don't get sidetracked or have to email back and forth or call because they seem to be "on-the-clock" for every email, call and piece of mail they send.

Good news since I contacted USCIS Tier 2 and finally got a receipt number. I finally got a "Touch" yesterday and it feels so good after almost 6 months since receipt of my I-601 at USCIS.......WHOOPWHOOP...... :)

Hopefully you will hear a YES very soon. Keeping my fingers crossed..
