After consulting with several attorneys we are giving up on US immigration and focusing on settling in Canada. Reasons being with a pardoned criminal history from 30 years ago it will take at least two years of immigration process and that is just not an option. I have young children who associate him as a parent and him being absent for that long would be detrimental. Also we can immigrate to Canada in under 8 months! So I think this will be our decision. Then if we want to immigrate him to the US we can do it while together in Canada and if he gets denied NO PRESSURE!

Are we crazy?

I guess it all depends on past criminal history. But no you are not crazy, It is hard whether there are problems or not but even harder when you know there are going to be problems. I am would do it a million times over but at the same time If it was going to take FOREVER I think he would have immigrated to Canada somehow.

The crimes were stupid youth petty thefts but fall into a gray area with consulate. We were told one official may wave us right through while the other may tell us to apply for a hardship waiver which is another 6-10 month wait. It just seems like a long time to be going back and forth as a family. We figure if me and the children go to Canada then if we decide we want to move back we will wait the required time but have breathing room to be together.

I think it's a personally resonable decision and I don't blame you a bit for wanting to move forward with your life together as a family. I hope whatever you decide for sure goes smoothly. I'm sorry that you have had to deal with such hurdles. it sucks. But I think you are right about the kids, and just think... someday you can move forward and immigrate back to the US as a family! Best of luck.

See profile for our K-1 Visa/AOS story from 2010-2011Apparently we love USCIS/NVC so much we left and are doing it again! This time giving IR-1 a whirl. Rock on immigrators.

04/09/2015 IV payment finally accepted by NVC after the set the wrong fee and took weeks to correct it.

*many more delays thanks to the agency processing my fingers prints to the RCMP and the post office losing our mail*

Its not like most of us are living in the USA because Canada is a terrible country,lol Hope its a smoother process immigrating to Canada than the USA, which I'm sure it will be! Could PM trailmix (if she is still around) as they did it fairly recently

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

Hi. In our case it was easier for me to move to the US since bringing my wife's 2 children (at that time) to Canada would have been more complicated. We are however considering moving back to Canada once my remaining stepson reaches18 (5 years from now). Would love to move to the Okanagan valley maybe ;)

I have never been to Canada (seriously!), but I'm sure there are some very nice places near the beach with little or no rain and all year round temperatures between 65 and 85 degrees like we have it here in and around Santa Barbara. Healthcare is a million times better, the people are better educated (it can't be the other way around), they speak English and French (I like both), so I wouldn't mind living there . . .
