Hi everybody. I'm new here and would like to know a few things.

My fiance sent out the i-129f in May this year through a field office in Philadelphia and made the required payment for the same. In June, they asked for some additional information together with affidavit of support which he supplied. Since then, we have not heard anything from them, he has not even received the NOA. Recently when he called the office that received the documents, they told him according to their records, the petition had already been sent to Nairobi and they had no further records. He was even told to re-apply (meaning he would have to pay again but I told him to hold on first we wait for like a month to see if anything would happen.

On Tuesday, I called the US consulate offices and spoke to a lady who advised me to tell my fiance to find out fron NVC and not USCIS the position of the petition and he is in the process of doing that. My questions are:

1) Is it possible that the petition could have gotten lost and we would have to re-apply?

2) How long does it take before you get any official communication from the NVC or consulate involved?

3) One of my children who is shown as my dependant in the petition turned 21 after the petition had already been filed. My fiance also filled out some form regarding this. What will happen?

4) I am made to understand that the US consulate here in Nairobi only recognizes one medical centre for carrying out he medical exam. Is this true?

Will appreciate any information that will help me understand how this works and what to expect.

It should have been sent to the Vermont Service Center. If he has had some correspondence about the processing of the application I am guessing that they forwarded it? Not sure. As for reapplying, if they have it they should be able to process it. Unless you get denied I see no reason why you should reapply if they have your petition. It sounds like you are in the system.

2) How long does it take before you get any official communication from the NVC or consulate involved? NVC would have sent a letter that the case has been forwarded to the embassy. He needs to call and find out.

3) One of my children who is shown as my dependant in the petition turned 21 after the petition had already been filed. My fiance also filled out some form regarding this. What will happen? No clue about this, maybe someone else can answer.

4) I am made to understand that the US consulate here in Nairobi only recognizes one medical centre for carrying out he medical exam. Is this true? Yes, there are designated places where you can do your medicals. The consulate in Nairobi can let you know where that its.

Will appreciate any information that will help me understand how this works and what to expect.

Currently all petitions for K1 go to Texas but back then Vermont would have been the right place. Does your fiance have a cancelled payment record ? If it did get into the system ( which sounds iffy ) and approved it would have passed through NVC on it's way to the embassy. Your fiance needs to get a case number from either the original office or NVC to find out status.

This will not be over quickly. You will not enjoy this.

I have no idea why he sent it to Philladelphia but he did get an email confirming that the petition was received (note they did ask for some additional information and the payment was cashed). I will ask him whether he has any cancelled payment record. He did call the NVC office and they gave him a date on which he should call back

Hi Irish15, i hope when your fiance calls back the NVC office there will be good news. If you will be going through Nairobi Embassy, they only accept medical reports from IOM hospital which is on 5th Ngong Avenue.
