Expedited petitions

not everybody can do that, personal circumstances are different. its not for us to judge where folk adjust status. some can. some cant. people can try to expedite if they wish, too. its an option given to everyone that files. its whether they meet the criteria or not that counts.

just my opinion.

I posted on visa-journey yesterday about expedited petitions, I would like to say to all those who gave negative feed back and cast heavy doubts about the possibilities of an expedited petition.

My wife and I had ours expedited and ACCEPTED TODAY

I'm not in the army, nothing to do with ill health... made an educated appeal and common sense prevailed ...

Looking at your time line, I am confused as to what part was expedited? The interview? When will that take place?

They say that every case is on its own merit, I do not know the reason exactly because we gave several but I think it was in our case the fact we were over due, so I can only say maybe you have a point, I really wouldn't want to advise you and give you foolish information... I will say

Why didn't you just Adjust Status after marrying on your K-1? Waiting 2 years to file is no real reason to expedite. You chose to wait. Just saying.

im sorry...i didnt say anything about WAITING to adjust status....im not being arsey but...why do people assume they know everything about someones case? admittedly, when i post, i do post a lot of info...sometimes too much, but i am sure i have never said anything about waiting to adjusting status while i was over in america...until now...

i was in the usa 18 months, we didnt adjust status straight away simply because of money, then any money saved was used to send me home as my dad was ill and since died....i left the usa without advance parole and after writing here for advice and receiving so many mixed messages...we lost all hope of me ever returning to america, to be with my 'now' family....lots of frustration and stress and having to deal with finding work, a house and on top of all this, loosing my dad....it was all too much...so time flew by and now we are both settled within our lives we are wanting to try and sort this MESS out...which is why we are here again, even though there are some people here who are just so negative, no one here has EXACTLY the same case as the next couple....

most people here have a vast amount of experience and i consider this a very informative site...with lots of reading and reasearch and i have learned not to take the first answers on a post as gospel...but to read and read and learn and when that is done - read some more and if still unsure, ask more questions....which is one reason why most of my freind list is full of BRIT and YANK couples...because only they can be said to be 'somewhat similar' in case progress!!

we are not using the waiting two years as a reason for an expedite...i previously said that (quote) curious because it would be nice to have ours speeded up because ( i know...its not much of a reason in some peoples eyes) by the time our I-130 comes near to being approved (hopefully) we will have spent 2 anniversaries apart...

which only means that we have already spent too long apart....it would be nice to have things speeded up a little...i certainly wouldnt be writing to the USCIS or NVC saying - ''hey up...sort out our case coz i miss my husband!''

i feel for you, my history is somewhat similar to yours. i had the obligatory ' why didnt you adjust status' actually on both times ive been married. once on the k1 to my ex wife - that was purely financial which lead to our marriage breaking down and now im in this with my wife and i returned home after caring for her while shes sick and we had zero money. it does annoy me when people judge. somebody asked me why didnt i extend my i94 to save an overstay - it was the last thing on my mind, my new wife was critically ill and we had no money, i knew i was going home and i didnt know you could do that anyway!

i hope you get your approval soon, keep on top of it and you might luck out

i too didnt know (until reading it now) that you could extend the I-94 in fact, we heard NOTHING from the USCIS/NVC or DHS about anything after i arrived over there...which sucked really...

i know we cannot expedite on medical reasons....unless they count that my husbands mum (who is 70+ and ill) is looking after his two teenage girls while my husband works all the hours god sends.

financially this is breaking us both....i know this isnt a reason for an expedite also

we both do what we have to do to survive...both of us thought that i was stuck here.

someone here also told us that we would have to DCF which was yet MORE wrong advise. which lead me to writing to the US embassy in london and they replied eventually telling us we need to complete and file the I-130 again...so...here we are!

the fact that we have already jumped through these hoops with the K1 in 2007 means nothing....we still need to PROVE everything....we still have the stress....which i consider to be somewhat harder because for one, i am missing sooooo much with the girls growing up...our family should be growing together - whereas it is growing apart.

my husband and girls coming over here to live isnt an option, for one, the eldest will kick up such a stink about having to leave all her new friends at highschool, personally i think that maybe if they saw how the other half live they would be more open minded about some things.

i do find it funny that when reading some posts (and i read LOTS) that some members respond to questions - you need to do this and that and someone else says no you dont, you do this....which leaves the OP totally headf**ked...or someone relplies with total NEGATIVITY. there are a few here who take the time to read questions and post good answers (loto for one)

this whole process is the hardest thing i have ever had to do in my life and i speak english! i really feel for anyone who has to do what we all do here...it is a long hard struggle and the struggle doesnt end once on USA soil....just like every thing in life - you have to work for it!

hey, you never know unless you try -

your mother in laws medical records - and also documentation that she is trying to raise two 'children'

your husbands financial documentation too - if he is in severe debt.

If not emergent medical, theres definitely, in my opinion an option of applying for an expedite on humanitarian / financial grounds.

The humanitarian aspect does count, i think in many ways you can look at it, somebody suffering with malnutrition in a third world country is one way of viewing it, but so is the children relying on their 'ill' ( for whatever reason it may be) elderly grandmother.

Thats an aspect we encountered in a way and we were approved. Granted there was urgent medical - but there is a cause for concern for 3 immediate relatives in the eyes of the US govt, in my limited opinion.

Id you may fit into one or more of these:

Severe financial loss to company or individual

Extreme emergent situation

Humanitarian situation

If you dont try you'll never know. But there are those that say a refused expedite can prolong the decision. I think that may be a myth. I may be wrong, but if you can provide solid documentation, the request will be taken seriously.
