Hello everyone! After reading through a few threads, I've seen that a lot of you are full of so much immagration information that you might be able to help me with a few questions!

I am a US citizen, living in the states, and I'm marring my fiance in January. He currently s Canadian citizen living in Canada, and we're wanting to get him down here as fast as possible. I have both US and Canadian citizenship, and we're planning on marrying in Canada. We have decided to go straight to bringing him is as a spouse, instead of a fiance, due to the long wait times, and him not being able to work upon arrival.

It seems as though there are many different immagration sites, but they all have so much gray area!

I'm really curious about the fees involved, as well as how long the process actually takes. Also, I've read that once the green card is approved, the VISA is 'conditional'. Again, they are not clear on the actual 'conditions'! Is it conditional in the sense that it's removable up until the second anniversary, or like he cannot work until the second anniversary?

I'm going to the federal building tomorrow to ask the officals all of my questions, but I have a feeling that you great folks on here will have much better information for me!

Uggghh! This is all so confusing and frustrating!

Hi Confused. I am going to move your thread directly to the CR-1 Process forum as that is where you will find the information which pertains to your situation. K-3 visas are pretty much obsolete nowadays. Welcome to VJ. :)

Read the below guides:

When your husband arrives in the Green Card, he can start working immediately in the U.S.

Since you would be married less than 2 years, you will get CR1 GC. That's why Condition removal is needed. So the second guide would be useful 21 months after his POE in the U.S with CR1 GC.

Total Fee:

I-130 filing fee - $355 (It will increase to $420 or so from the end of Nov this year)

Affidavit of Support Fee - $88

Immigrant Visa Fee - $404

Plus medical fee and other misc. charges such as mailing, photocopying etc.

A "conditional" permanent resident is a full permanent resident, having all of the rights, privileges and responsibilities of any other permanent resident. The only difference is that their PR status expires automatically after 2 years. Conditional PR status is converted to permanent PR status by filing an I-751 Removal of Conditions form within the last 90 days before the conditional PR status expires. The I-751 and it's accompanying evidence shows that the marriage the conditional PR status was initially based on is legitimate and ongoing.

Since your future spouse will be entering, after you marry and finish the application process, on a CR-1 visa, he will be able to work the instant he enters the US. His PR status is no more [or less] removable during the first 3 years than any permanent resident's. As I said, he is a full PR, once he enters on the Cr-1, in every way, except that his PR status will expire and he must file an I-751 to convert it to full PR status.
