So, my hubby has been working at his company for more than three months now, He didn't file taxes the past 3 years because he was unemployed and was a full-time student.

His boss understands that we have to fill out the I-864 and we're supposed to report how much he makes and that he pays taxes at work but he hasn't filed in the past few years but can definitly support me with his income (well over 125% of the 18k poverty line). However, his pay stubs don't equal the required 18k yet.

He is in no danger of getting let go, we have a great friendship with his boss and co-workers, he is innovative and works hard and brings a lot into the company.

However, due to the short amount of time that he's been working there, he has yet to reach the 18,000 mark and currently, with all of our assets put together, it does not equal 18,000 right now, at this current time. However, in a year, he will make way more than 18,000.

So, what should I do?

His boss is writing us an affidavit to basically just explain a lot of the stuff I just wrote. It will be in company letterhead.

Also, does it have to be sealed? Who should I write it to? Just the USCIS in general?

He has to prove annualized income that meets the requirement. Not year-to-date income. The paystubs will prove the pay rate.

The employer letter should give position, length of time employed, rate (hourly/monthly/annual), and expected term of employment. ( doesn't have to be a specific date. something to the effect that he has a permanent position). No long story required by the employer. Just the facts.

The sponsor must include a statement explaing why they were not required to file a tax return in any of the past 3 years.
