Yes but i perviously said that i think that they misupdate it ....because if they would deny something ..it would be the i-130 ...and if they would deny the i-129f they would have to send a RFE first before they deny...so i wonder how did that happen.

sam i cant give you the answer to that but you will get advice from people that know what youre going through as they are and have been in a similar situation. theres a lawyer that does a free chat on a wednesday, shes very helpful. its up to you my friend, im just throwing some ideas out there.

I have already contacted tier 2 and lawyer....tier 2 said that they don't see anything else on their pc...lawyer said that he can't do anything until he knows the reason of the denial...for the senator....he has no power and i wouldn't contact him before i receive a hard copy because it might be the approval not the denial...so i have to wait to see.

im wodering did they expedite your service request or decide to make a move on your case cos theyd sat on it for a lengthy period of time..

seems very harsh to me and my first stop would be the lawyer to find out what he actually did for you that didnt do you any harm.

Not discouraging you - Accompanying petition (I-129F) can be denied without RFE, if the main petition (I-130) got RFE and denied.

Your best bet is wait the letter of "Notice of Action" whether it is approved or denied by mail and act accordingly.

If it is approval, you are all set.

If it is denial, appeal it.

Your best bet is wait the letter of "Notice of Action" whether it is approved or denied by mail and act accordingly.

If it is approval, you are all set.

a good tier two will do some digging around and can find out whats going on. some of them are barely as much use as the csr but some can be very helpful. its worth a few tries with them

well. you applied for an expedite. whatever happened they worked on your case soon after, s id go with loto, appeal and if at all possible apply for an expedite with it.

1) Why they denied

2) Whether you have the right to appeal

3) If no right to appeal, about the motion to reopen the case is possible

4) If there is right to appeal, what action must be taken from your side within the next 30 days time

I didn't realize they did background checks while the file was still at USCIS. I thought that came later, before the interview. Maybe that's what takes them so long to process the files.

Yes i know...and they took 3 months or more doing background checks for me...i felt like they think iam a terrorist...lol...
