The reason they were going by RFE date originally, was because the only work they had to do was to process the new IMBRA"S that were first coming in REGARDLESS of noa1 date. NOW, they have a back log again and can go by noa1 date, that is why you are seeing march and april approvals, and why alot of the approvals are coming from other than CSC originations I got this from the my best source.

For me my noa1 was 5-15-06, RFE recieved 7-10-06 and touced once since on August 19th, waiting for approval.

If ONLY..... I had sent back my IMBRA form a day or two earlier I would have been approved 2 weeks ago, now it could be 2 weeks more, given no RFE #2.

Don't know who your source is but I can say this. It is clear there is no real order here. For a while it seemed it was RFE return date (obviously the most inequitable way to do it). But there are many early July RFE returns that have not been approved. There are also many early March NOA1s who have not been approved.

It does not matter if you had returned your IMBRA RFE one or two days earlier - there is ZERO guarantee that you would have been approved two weeks ago. Every case is different and CSC and VSC operate differently.

Relax and do your best to be patient as there are many many many more March NOA1 dates before you.

I do not know who/where your source information comes from, but you may be correct. A couple of the recent approvals had mid-May NOA1 dates, but the majority of approvals are now concentrated on March and April filers. Let us hope that they have learned something and adjusted their processes. We can only keep watching Ulings chart to see what the trend becomes.

Timeline

I've been researching and keeping track of NOA2's, based on what I've seen and noticed. USCIS gives themselves 60 days to process an RFE after receipt of the RFE. If you don't hear anything within 60 days I would be surprised. If you don't hear anything within 60 days, USCIS says to call them. Good Luck!!

I'm happy if that's true, but it doesn't seem as logical as that. Also I don't think you can assume that if you'd sent back your IMBRA form earlier, it would have made any difference at all. I sent back mine right away, July 5 I think it was, but it wasn't acknowledged until July 17. It probably depends on which particular pile on which particular desk it lands on that day and who decides to pick it up.

I am wondering if I shouldn't have my boy call them and give them my new address, but I am too afriad to have a clerk pull the file from wherever it is to update it, and risk ending up at the back of the line again!

I figure it is safer to wait for NOA2 (whenever) and then call the embassy, but it makes me laugh that I am reduced to worrying about having someone touch my file and lose it.

To respond to who my source is and to clarify. My Lawyer is friends with someone that works at the CSC.

Here is what he said and it makes perfect sense despite the difference in opinions that have been listed.

1) First it is only the RFE reciept date from the USCIS that matters, not when you sent it or when it was delivered.

2) They had almost completely STOPPED processing i129f's by late June because of the IMBRA issue.

therefore when the FRESH IMBRA RFE's were recieved, they immediatly started to work on them, regardless of noa1 date. Obviously they would take a noa1 from Late May for instance if they had not even recieved someone that sent in March's RFE back yet.

But NOW that they have plenty of work to do becasue all the IMBRA"S are filled out and back to them, they are going back to noa1 date again. It is just what happened. It isnt debatable.

They just took an initial batch of IMRBRAs for the first several days they were returned.... and processed those and now they are back to the normal processing.

3) I dont mean to offend the March filers, I want you through as quickly as possible. BUT their is a reason that their were may's processed before March's in some cases as I described above. SO yes the system is horrible, but it is not just totally random at all times.

The bottom line is this, they (USCIS) fcuked up the entire IMBRA process.

They were not ready to implement IMBRA to begin with, then,

They sent IMBRA RFE's out in a random order, then thought to process based upon receipt date.

Now, apparently, they are processing many March and April cases. Track the latest approvals to validate this statement.

Everyone will get done, but, at the end of the day, it should have been done in order.

RFE issuance by NOA-1 date, further processing by RFE return date.

If we did this type of shoddy work in our jobs, we would be shown the door. Simple as that.

I honestly dont know where the information came from. I have heard a lot of 'this guy said this, this other guy said that.' I don't put a lot of faith in anything to do with this process any more. (even if the csc director told me directly). I will just wait and see when I get an NOA2.

I hope your right. If so it is accurate information, that is great news for me. Thank you for posting it. Its just hard telling what information is accurate any more.

William33 you are exactly right!! it should have been done better. And you are right in saying it is what it is and everyone will get done. :thumbs: you have to have faith, you have to have acceptance in the waiting, and you have to believe that in the end you will be in your loved ones arms!!

I guess the lawyers friend could be correct but I see a gaping hole in that logic and thats all the people who have not received the IMBRA RFE yet.

I hope you are correct and that the CSC is processing the RFEs by NOA1 now, at least that gives hope to the March Filiers.

Does the NOA2 come by snail mail or e-mail, or is it stated on your account on the USCIS web site right away????

I want to know should I be running to the mailbox each day with hope? Or just checking e-mail or the website????
