AOS - K1 VISA HOLDER -- NEED HELP

hi guys! i need your help once more.

i am going to send our package tomorrow for the AOS.

yes i have read the guide.. but this is what confuses me.

i have already gotten my vaccination record or DS-3025 from ST.LUKES before getting my k1 visa.

aside from the form i have received a cd for my xray from ST. LUKES

given these information: i came here as a K1 VISA HOLDER, no kids, and just got married last month (September 2010)

i need to ask you the following questions:

1. do i give them the original DS 3025 or will a photocopy suffice?

2. do i need to send them this cd too?

3. do i need to fill out the Form I-693? coz the site says I don't need to fill out that form as long as i have gotten a medical examination within a year. follow up question: if this is so, why does it say that i have to show an evidence of the REPORT OF MEDICAL EXAMINATION AND VACCINATION RECORD... is this the DS 3025. coz my DS 3025 is just a vaccination documentation worksheet.

4. is there another form that i have to fill out to be attached with my DS-3025?

Look at the results on the lower left part of your DS 3025, if your vaccination history is COMPLETE, you don't have to go to the CS for the transcription, however, if it is incomplete, then you need to have your DS 3025 transcribe by a CS. You can find more threads about the I-693 under the AOS forum. When you go to the CS, you will just show the DS 3025. You only need to fill out part 1 of I-693, take it to the CS.

1. Photocopy. Make sure you keep a copy for yourself

2. No. The x-ray is irrelevant

3. Most likely. If your form says "incomplete" you only need to complete Part 1, Part 2 (vaccination table only), and Part 5. It's to ensure your vaccinations are up to date. Given that you had 6 months to arrive on the K1, 3 months to marry, and no deadline to file AOS, it could have been a while since you had your vaccinations so that's why this is needed

4. If you need to complete the I-693 then that. Otherwise you just need the DS-3025 if it's marked "complete".

USCIS doesn't have the responsibility or authority to determine if you've met the vaccination requirements. Only a doctor approved by the US government can do that. This means either a panel physician in the foreign country, or a civil surgeon in the US. My wife and step kids also had "may be eligible for blanket waiver" checked on their DS-3025, and the civil surgeon still determined they needed an MMR shot and tuberculin skin test (yes, they had chest x-rays at the medical in Vietnam). On the other hand, the civil surgeon might determine that no additional vaccines or tests are needed. Whatever the case, an approved physician has to sign off on the vaccinations, and the panel physician at St. Luke's didn't or couldn't. You need to see a civil surgeon.

ok... i guess chris and i are stubborn...

we wanted to mail off the application right away with a copy of my DS-3025

but at the same time i got the 2 numbers of civil surgeons around our area...

so while we're waiting for the RFE letter... we're going to schedule an appointment with them and have them transcribe our I-693

sigh... so much hassle..

then we'll mail off the I-693 after we get the RFE.

we just wanted to file it ASAP. i've read that you can't leave the country once you have applied for the AOS...

not until you get the result from your application. so while it's still pending, you have to stay in the country.

my I-94 expires on Nov 17, 2010. We just wanted to at least get the application there.

so we mailed the application last friday. so hopefully we'll get a receipt from them this week.

if you have added information, please do let me know.

Basically the idea behind getting the I-693 BEFORE you mail the package is so you don't get an RFE (you still can 'cause sometimes they lose your initial K1 medical). An RFE can slow your package down around 2 months, even if you reply to the RFE quickly... basically your file is put at the bottom of whoevers desk it was on.

If you've sent your packet then i wouldn't bother with the I-693 now until you find out if you're getting an RFE. Some do, some don't. If you don't get an RFE you wasted the money on the transcription. If you do get an RFE then you have 30 days to reply, and it shouldn't take that long to get it.

Other issue is you MIGHT get an RFE for an ENTIRE I-693 medical (this also happens when they lose your file). So you're much better off now just waiting to see what happens. Otherwise you got a vaccination transcription for no reason, and then had to pay for an entire medical on top of it.

If the "incomplete" box was checked on the DS-3025 then you will almost certainly get an RFE. You can do as Vanessa suggests and just wait for the RFE. If you decide to go ahead and see a civil surgeon then go ahead and do the full medical, as well as the vaccines. It will cost more, but you'll be covered regardless what the RFE says. One reason for getting a head start is that the civil surgeons in your area might need several weeks notice for an appointment, and you'll have a limited amount of time to respond to the RFE.

Regarding travel, a K1 visa holder can't leave the US at anytime until they receive either advance parole or a green card. The K1 is a single entry visa, so you can't leave even before you file the AOS, at least not if you want to get back into the US again.

The USCIS adjudicators are clearly instructed how to evaluate immunization forms. They have a chart to look at and are instructed on specifics like make sure the DTP/DTaP/DT or Td/Tdap series has had a booster within the past ten years if the series was given as a child for example. They are instructed on when they can grant blanket waivers. They are even instructed that if the Civil Surgeon marks that all requirements are met, they still must look at the specific shots for evidence of compliance. and send it back to the applicant if shots are still needed.

They are looking for

19 through 26 years · Td or Tdap (if DT, DTP or DTaP shown: okay to accept) · MMR · Varicella

27 through 49 years · Td or Tdap (if DT, DTP or DTaP shown: okay to accept) · MMR · Varicella

50 through 59 years · Td or Tdap (if DT, DTP or DTaP shown: okay to accept) · MMR (if born in 1957 or later) · Varicella · Influenza (during flu season only; October 1 through March 31)

My opinion is still that if those shots are clearly marked on the DS-3025, then it can prove that the admissabilty under immunizations has been met without a further form. (Please note the within 10 years comment above on the diptheria/ tetanus/pertussis) The form does not have to say complete if there are reasons the officer can grant a blanket waiver (like inappropriate for age, allergic, etc) The reason "not readily available" is not eligible for blanket waiver because if the particular immunization isn't available in your country, you can get it in the US before AOS. Any shot given in the US will have to be recorded on an I-693 along with copying over any shots listed on the DS-3025. In that instance, the DS-3025 should not be submitted with AOS because your I-693 is the most up-to-date record of your immunizations.

Any idiot can read the forms and the requirements and determine (with reasonable accuracy) whether the required vaccinations have been administered. My point was that the law requires the determination to be made by a panel physician or civil surgeon - not an immigration officer.

thank you! :) yup that's what it said on mine... i'm 28 years old.. and it said that it was inappropriate for my age.. and yes they did have check marks on the vaccinations that i got from the clinic.. especially the TDAP :)

You can get RFE's even after the interview itself so no, not out of the woods. just wait and see :)

we got that planned out... i guess right now we're more focused on being here together. :)

they can take their time if they want. granting that, while the application is there, i can't leave the country.. and that means they won't deport me! and i can be with my husband. that's all that matters to us now.

another quick question though... we live in florida... why did schedule our biometrics appointment in Louisiana?

another thing.. i saw in the timeline section that there are 3 uscis local offices in Florida that we can drive to.

what are those local offices for? is it for the biometrics or for the interview?

Biometrics are done at Application Support Centers (ASC) which can be different than an interview location. Here's the page to find your office

I think the Louisiana thing was a mistake, You should try a walk-in appointment at your closest office, showing the appointment notice. Lot's of people go for biometrics early once they get the notice and are not turned away.
