NVC Case complete is no guarantee docs are cleared for good

If you are going through NVC you are surely crossing your fingers hoping to get through it without getting an RFE. We sure did.

When we got our SIF I called NVC to check our status. I still remember the lady's voice saying something like: "Oh, your case was just completed. Congratulations! You're done!"

With that being said, we felt a huge relief and thought we had managed to clear that hurdle without getting a dreadful RFE and the delay it always implies. We assumed the only hurdle left in front of us was the interview which didn't concern us much.

So, it was quite a shock to find out the day of the interview that one of our documents wasn't what they expected. We were able to correct the problem eventually but this cost us a delay and an emotional pain we certainly didn't expect.

I know that's not what you want to hear but, beware. NVC accepting your documents and not issuing any RFEs do not guarantee you're done with the documentation burden. The embassy will check your documents and may still question any of them.

It's clear to me that NVC failed to catch the problem. They should have issued an RFE. It would have been a pain but I wish we did. Getting it later on when we didn't expect it anymore was worse. We paid the price for NVC's failure.

And NVC is Department of State, embassies are Homeland Security, so embassies aren't bound to honor NVC's decision in any way.

Hope for the best, prepare for the worst. And good luck. You definitely need some to get through this without a hitch.

What was the document you wish the NVC gave you an RFE on ? What was the problem with the document?

The NVC and Embassy are both actually under the Department of State - however, the Embassy has a greater understanding of the culutre of the country and of course makes the final decision according to its own guidelines.

CR-1 Visa Was Approved :-)

Entry Date to USA: 2/3/2011

12-10-2012 - Sent off I-751 packet visa USPS

I751 Was approved - 10 Year GC was granted

N-400 Progress

4/10/2014: Package Mailed
4/11/2014: Package Received
4/14/2014: Notice Date

Correct. USCIS is Homeland Security while NVC, Embassies and Consulates are Dept. of State. NVC helps the Consulates obtain paperwork but Consular officers make visa issuance decisions.

To those who asked politely: I posted the details of the particular problem we faced in another thread: Criminal record / Police certificate from Canada.

But this is rather irrelevant to the point I wanted to highlight here which is that you can't take for granted that your documents will be deemed acceptable by the embassy because NVC accepted them.

My hope in sharing this is that it will make it less shocking to the unfortunate people who face a situation similar to the one we did.
