I need Help Please - IR1 vs K3/K4

I started the peticion porcess for my wife and her son in May (NOA1: May 12 2010). The case was send to California Service Center and looking on the USCIS web side about the processing time say that it takes 5 months. I passed that mark and now I am debating about applying for K3/K4 because some lawyers advise me that this route can expedite the process. Do you think I should keep waiting for NOA2 or I should file a I-129F for K3/K4.

I don't know if K3/K4 will also expedite the process at the NVC?

You're definitely better off proceeding with CR1 and CR2 instead of K3 and K4. No extra fees needed for Adjustment of Status, and both your wife and her son hit the ground running, they are eligible for green cards after arriving in the U.S.

02-23-2018: Sent N-400 Application online

02-23-2018: Date on NOA, retrieved from online account

02-23-2018: Date on Biometrics Appointment Letter (Biometrics Appointment at Jacksonville ASC on March 13, 10:00 a.m.)

03-08-2018: Biometrics complete

04-05-2018: Case status updated - Interview Scheduled on May 10, 2018, 10:15 a.m. :D

05-10-2018: Citizenship Interview - Passed English and Civics Tests, Recommended for Approval! :D 

06-19-2018: Received email and text notification: Naturalization Ceremony Scheduled; waited for letter to be uploaded on online account - it has been set on Wednesday, July 25, 3:00 p.m.

07-25-2018: I am now a U.S. Citizen!

Anyone advising you to pursue the K3/4 process at this time is incompetent. K3 and K4 are no longer available as of 02/01/2010.

Besides the fact that your lawyer has outdated information... the K3 is basically unattainable now, and not any faster than CR/IR1.

Have you called USCIS and told them that you are outside of processing times?

Since you are a couple of weeks past the 5 months, your best bet is to call USCIS and try to get to a tier 2 person (not sure how you do that). If that doesn't bear fruit in a week or so, then it's time to call your congressional rep/senator to get them involved.

No, the K3 and K4 are no longer available. You can file the petition but it will not result in a K3 or K4 visa and will not speed the arrival of your family members. It may slow their arrival by quite some time, actually. Just don't do it.

As to 'time' -

Sorry, when the I-129F shows up, it'll get joined up with the I-130,

and

the I-130 will lose it's place in the queue,

and will assume the new place in queue of the I-129F -

which will be another 5 to 6 months.

I suggest you read the content in the links above (links are safe to click, trust me, will not install any malware on yer pooter)

and then if you paid money to any attorney to prep an I-129F, after reading that stuff - well, you know what to do (demand a refund).

IMO, wait another 3 weeks, then go nuts with a Tier 2 Human (see http://www.dhs.gov/xabout/structure/gc_1221837986181.shtm#5 )

Thank you again. I am still waiting for NOA2. I called USCIS and they told me that California Service Center (where my case is located) will contact me in 30 days. Hopefully it will speed up the process. All the information you provided helped me out to stay with CR1 and forget about K3 at this point.

My case was processed in the same center. They state aprox 5 months, but in reality, they are only working on thr cr-1's received as of the end of the March, 2010. I would call and demand to open a service request which they have 30 days to respond to. I called every 7 days after my case was outside the "normal processing time" until their system would allow them to process a service request. I did that and within 7 days after opening the service request, they approved my case. You cannot contact your senator until they do not respond to this type of a service request. The senator cannot do anything until the aditional response time has expired. Good Luck!

Congrats! I realized that our timeline is about the same. I called last week but I did not have the posibility of process a service request. How did you obtained a service request? Thank you for the info!!!
