Hi guys,

It's been almost 7 months that my case's been there... done my biometrics over a month ago... and my lawyer says I can't speed up any process and he can't do anything...

so I was thinking If I'd call USCIS what should I tell them? what's the status with my case? or why is it taking so long?...

... is it worth to call? or pointless?

on the website is still there at the soft touch (that wasn't notified by email or text) on 9/17

what's your suggestion?

this is my timeline:

Year 2010: Married to USC

03/27 Mailed I-130, I-485, I-765, I-864, G-325 to the chicago lockbox

07/26 Rejected (my attorney gave me an old I-485 form to fill out)

08/03 Mailed again all of the above (with correct I-485 form)

08/11 Receipt notice

09/15 Received Biometrics appointment scheduled for 10/8

09/16 Walk-In at the Chula Vista ASC in the afternoon, Biometrics done...

09/17 Soft touch. I-765, I-485

You should definitely call USCIS about your case...looking at your time line, your case is waaaaaay out of normal time lines if you filed back in march. Call them and ask to speak to an IO they may tell you more than the ppl who answer the calls do. Also have you tried calling your Congressman to see if they can offer any help? That may be an option to consider.

If you call the number, all you are going to get it's a live drone repeating what you already know... they may add that you need to wait until xxx amuount of days (90 from the NOA) and if you havent gotten your EAD yet, you have to call them back... if that ever happens, don't call them, cause they will tell you this: make an infopass appointment online...

you're pretty close to geting your EAD and you're being impatient about it.... chill... go for a walk... call your family... do whatever it is to get over this very few days until you get the EAD...

You mentioned that it has been almost 7 months since your case "its there"... but then you said that you got the "receipt notice (NOA) on the day of my bday: August 11th, so, officially, it's been a little over 2 months and for what I have read, the Chula Vista office it's backed up, so if I were you, I will get online and try to make an infopass appointmet for Nov. 12 (the day after your 90 days "limit"...

As far as your lawyer: seems to me that he does Immigration as a "side job"...

SISJ: you will make your waiting time shorter if you do a "walk in"... (just go to the same office that shows on your Bio appointment notice, bring the notice and a picture ID (driver license, passport, etc)

I 485 was the holdup, they should have noticed it when they received the packet but that is water under the bridge now. As the other poster said, now that they have the complete set of documents they need your case should move along nicely. Wait a couple more weeks and you should see progress.

Oh well I guarantee you that he's not just in a side-job for him, that's why it's disturbing... that's annoying anyway because I'm losing job opportunities....

so I would love to get my EAD as soon as possible and I see people's timelines that are amazing... 2 months and they have already the appointment letter and EAD or 1 month with fingerprinting done... :|

do you think it's possible that my case is backed up because of my attorney's fault?

SISJ: you will make your waiting time shorter if you do a "walk in"... (just go to the same office that shows on your Bio appointment notice, bring the notice and a picture ID (driver license, passport, etc)

I see you also live in NC...does the office accept walk ins? I don't want to drive all the way to Durham and then be rejected, it's about an hour drive from Greensboro. Have you ever tried a walk in?

I did a walk in in Charlotte without even having the letter appointment!

That's cool!

yesterday I called USCIS but unfortunately after 8pm... so I am probably gonna call back today.. and see what happens :)

nobody ever told me if... by having a Lawyer involved... I schedule an infopass, can I go by myself? or I risk to get an RFE just because I didn't go with my lawyer... ?

This is a perception issue. Your case is not "backed up" you got your receipt notice 8/11/2010 according to your time line.

Your original application was "rejected" due to your attorney not filing the correct form , so in a sense yes its his fault but now that it is correct your time line or period of waiting doesn't start on when you attempted to file the original petition with the wrong form, it began processing when they received the correct documents. So that is what now a little over 2 months?

Your counting the time from the original attempt to file but "rejected attempt" is like not having filed at all, and the new application that is correct gets put in the processing que when it is complete.

You can all USCIS or go for an info pass appointment, but my guess is they will ask you what your receipt date is and then say hey.. its going along as it should you should hear something soon.. which is what I think will happen.
