One of my cousin does not qualify because of his age. My mother had applied for her sister via I130. Now we are in the middle of paying AOS fees and his name does not show up because of his age. But this cousin of mine is dependent on his parents. Do you know if they would grant him visa? what is the process, who should we contact? NVC or let the consulate know when they contact for interview etc? please help!

MENTAL illness doesnt prevent anyone frrom going through the process.... now they are required to pass the medical review like alll other applicants. There are many have have had success in cases such as yours.

Thanks for the reply. I know there is CSPA. I couldn't find anything regarding a child who is over the age limit but mentally retarted. is there any information available online for that? I know there are exams that can prove the mental age but I just wanted more information regarding the whole process we will soon have to face.

Does CSPA apply? It is not a medical issue for CSPA.

The Consulate may well want to know how his medical insurance issues will be addressed.

The Sponsor needs to bear in mind that they are most likely always going to be on the hook.

I have seen a sort of similar case on a work visa where an aged out child was paroled in for the duration of their visa.
