Hi,

We rec'd and RFE for the medical forms which were turned over in the sealed envelope at POE. We responded to the RFE with a letter explaining that they have the ppwk or my husband could have never come on a K1 visa last Dec. We were told by the USCIS that our case was turned over to the requesting office, the CSC. I am wondering if there is a time frame in which to expect a decision or can they just take as long as they want? I am hoping for a quick decision so we know what to do to get our case moving again, but knowing the USCIS, not expecting this.

They can take as long as they want. Last time I read someone responded like you did they had their AOS denied because they didn't respond to the RFE and had to pay to re-open the case.

Well, I hope this won't be the case for us as two different USCIS officers told us this is what we had to do. And their website says they received our response and will be making some sort of decision, Also, since it has been forwarded to the CSC, I would hope this would mean they don't see us as not responding. I am still hoping the congressman's office can help, but at this point it is starting to look like my husband and I will have to pay for a whole new medical. This just REALLY pisses me off to no end.

They can take as long as they want. Last time I read someone responded like you did they had their AOS denied because they didn't respond to the RFE and had to pay to re-open the case.

Buster 2009's RFE had multiple issues with it. One was the medical, another was whole pages missing from the I-485 or the I-864. Since they responded only to the medical portion and not to the missing pages from the forms, that's why they were denied. The argument was that the RFE was poorly worded so it wasn't clear that there was more than one thing wrong.

Or were you talking about another case?

So here's the latest update on our RFE status. We replied by letter to the RFE as an officer told us to do from USCIS. We engage the assistance of our congressman's office. We stopped by his office today and he gave us a copy of the email his CSC liaison sent him. It says that on the 10th, they send us an intent to deny!!!!!

We haven't received it yet, but needless to say, we are very upset and freaking out a bit. I guess this isn't a denial yet, but we will have to figure out how to come up with the money to afford another medical because of USCIS's incompetence. I just cannot believe this. You do everything the right way. Jump through all their hoops and they still twist you around to wonder why anyone would want to immigrate here in the first place.

Nope. They don't keep the records on file. I wonder what kinds of kickback the USCIS gets for having people go to THEIR approved CS to their medicals, over and over! I even called the USCIS just after I posted this update. The officer said, on her screen, it shows the ITD hasn't even been mailed out. Yet the email to the congressman from the CSC (we have a copy of it) states it was sent to us 6 days ago. She said that when stuff is mailed, there is an entry made in the computer stating that something was sent, and there is no such entry. The USCIS website status still says our RFE response is under review. Maybe they intended to send us the ITD but then received our RFE response and didn't send it. We don't know. All we DO know is that we are sitting on pins and needles here. The USCIS officer took my phone # and said she was going to have someone call the CSC to find out exactly what was going on and then call me back in a day or so. I will believe that when I see it. In the meantime, my husband will have to find a new CS to waste our savings on.

Just talked to our congressman's office. The guy told me they are "stepping out" of the case now because they can't get any answers from the CSC, so there is nothing else they can do. No idea if we are even getting an ITD or not. We are very confused and upset about this #######.

No...haven't talked to any senators. Just the congressman..and obviously, that got us nowhere. I am waiting to hear something from the USCIS, but I think we are going to have to suck it up and pay for this again. I am really upset about this but feel like we may be backed into a corner. Or maybe we should think about me immigrating to Holland.......

What was the date that the initial medical was done? If it was more than 365 days from when you filed for AOS the issue is not that there was no medical in the file, just that it was too old... just one possibility.. in any case, if they didnt have the medical or could not find it, they have no real option other than to deny unless you get a new one done...

No, The medical was done well within the year time frame. They simply lost it. So, I called my senator's office today and explained the situation. She is the immigration expert there. She asked where my husband's POE was and I told her LAX in Los Angeles. She said, "Oh, that's unfortunate. I hear this same issue over and over for people coming through LAX. USCIS seems to have the biggest issues with people who's POE is there.," GREAT! She also said we could fax her all the info, but she will be out all next week and is so swamped with work, she didn't know if she could even get to it soon! So much for our elected representatives.

On the bright side, my husband talked to a CS office today and explained the situation. They said depending on what needed to be done, we might have to only pay $108 instead of closer to $300.

Still haven't gotten any ITD in the mail, and it doesn't say anything about any update on the USCIS website.

I guess I will be calling them once again tomorrow to TRY to get somewhere...ANYWHERE.

I called the USCIS again and talked to an Officer Mencia this time. He was very nice and just a little helpful. He said an ITD WAS sent, but not on the 10th as they told our congressman, but on the 16th, so we just haven't received it yet. He said...and this was kind of funny, "When you get the Intent to Deny, I BEG you to just get the medical done again. I can't tell you what they did with the paperwork, but they WILL deny you if you don't do it again. I am sorry for the inconvenience."

So, after all the ####### we went through, and the millions of people we have talked to at the USCIS, we are going to get the medical done again, and just move on. I am so beyond pissed I can't even express it clearly.

But, after being told by my state Senator, and several USCIS escalation officers that there is an ongoing problem with the POE at LAX and the California Service Center, we are going to try to somehow, bring this to the public's attention. Maybe some news stations would be interested in an investigative story or something...I don't know. All I do know is that this is such an issue that our state officials hear about it all the time and are doing, or can't do anything about it.

My husband is talking to the CS office right now, who is saying that they can't fill out or even get the forms that the USCIS is requiring from us.

After my 3rd call to USCIS just this morning, we have discovered they USCIS is not asking for the DS-2053, DS-3024 or DS-3026 at all. They want the I-693 filled out again. They have vaccination portion but the medical portion wasn't filled out because he had his medical done in Holland. The RFE was very confusing in it's explanation of exactly what was being required.

So, because they lost it, and the medical is now outdated, he will have it again, the doc can fill out the form again, and we can move on with our lives again, until the USCIS decides to screw with us...again.
