what last name to put on forms??/

Timeline

Hey everyone,I am trying to fill out the forms for adjustment of status.We got married just a little over a week ago and I haven't changed my name on my SSN or anywhere for that matter.Now that I'm completing those forms do I put my last name that I have on the visa or do I put my husband's last name that I am willing to take?Thanks

Put your name that you want to appear on the greencard.

I think it needs to be whichever legal name you currently have...but for such question, i really recommend asking an attorney :) google "immigration attorney free consultation"

Use your new last name. The marriage certificate you send shows you married Mr. "Smith" and that's why you name is" Smith" now. P ut your full maiden name anywhere it asks for other names used.

If you she did that she would have to pay another fee later on to change the name on her green card. Seems silly to me.

You put whatever name you now have. If you're keeping your maiden surname, put that. If you're taking your husbands surname put that (remembering to put your maiden name in "other names used").

The fact is, the new married name IS your legal name now.. if you chose it to be. Your marriage certificate is your permission to change your name. You don't HAVE to, but you can. Changing documents is how you "prove" your decision to immigration and other officials (like banks etc).

I still have my SSN in my maiden name. I got my GC in July but I just haven't had a chance to change it at the SSA and I had NO issues with my AOS process.

So, put your married or maiden surname, depending on which you WANT to take. If you don't put your married name on your forms, but want to once you receive the GC, you would need either to wait for ROC or Naturalisation to get a new card/document in your married name.. unless you wanna pay the $300+ fee for a replacement card to be issued in your "new" name.

In my opinion file with your MARRIED name… there is a section on your application that asks for any other names used put you madden name their … my wife just got her 10-year greencard with her married name… you can save a lot of money this way …

If you are using your husbands last name as your last name all you need is you marriage certificate .. if anything else needs a court issued document

We are about to file (a month late at that)... do I need to re-do the AoS applications? Use her married name or use her maiden name?

Forget the K1 files for now. AOS is a new process. She is a married lady in the US. What name will she use at the bank? the kids school? Blockbuster? If it is your last name, then that is the name she wants on her green card. You must apply in that name for it to be her GC name. When you travel, carry the marriage certificate to explain why her passport name is different from the GC. When her passport expires, get a new one in her married name.

If it is your last name, then that is the name she wants on her green card. You must apply in that name for it to be her GC name. Thank you! And thank you for answering what would have been my follow-up question about the name difference on her passport. Do you know if a standard copy of a marriage cert. will suffice if traveling, or should we bring a certified copy?

I would personally choose to have a certified copy when dealing with international travel and various securities and airlines. For domestic travel, she can use her GC or drivers license for travel photo id and the passport need not be shown.

it's important that she shows legally why her name will be different than that on her passport. When I filed I-130, they mistook an R with a B. They didn't find my record (even though i provided my A#) and the I-130 approval notice said i didn't qualify for AOS since they thought i'm illegal. Had to write back with the correction and things were fixed. But this is to show you're dealing with drones, not people.

Seems even sillier to me.

Not to be antagonistic.. but I see no such post by you asking what name to apply in. I checked because I don't know how you could possibly ask this question and have EVERY response state "maiden name". Please show me the post in which you asked this same question so that I may post in the thread to correct it for anyone else that finds it.

For whatever reason I am unable to find it in my post history, and as my memory clearly holds no water with you I'll simply apologize and thank you for your help and everyone's help so far. Honestly I should have been able to figure out that my wife should use her married name as the sample i-485 has it that way. I guess I've been looking so hard at all of these forms that it is beginning to blur into a big mess.
