Hello All,

I am currently filling out the I-485 and I-130 forms as I wish to adjust my status through family based sponsor (My Wife, I am currently in the U.S, out of status)

Now as you all probably know these forms can be very confusing and overwhelming. Specifically the I-485, May somebody please assit me with the two following problems I am facing.

1) the I-693, Am I supposed to get the medical examination before I send any of the forms in, and therfore send the I-693 in with the I-485, or shall I send the I-485 and then subsequently I will be contacted with the order to visit a doctor?

2) The I-864, Letter of support. My wife who is filing with me is a student so her income does not meet the requirement, I have a close friend that will fill out the I-864 for me, however this friend does not live in our household. Thefore will my friend and wife be required to fill out this form, or just my my friend.

Another problem i am somewhat worried about is, my wife who is filling for me, has not yet changed her last name (to mine), therefore our lease, bank statments, and etc. all have her maiden name on them, do you think this will hurt our case in anyways?

You will do the medical first and send it along with your whole application.

Your wife is your primary sponsor whether or not she makes enough money. They will both need to fill out the I-864.

The name change should not matter at the moment as your wife's current name is on the documents and that name will match the name you put down as her name on the forms. If she decides later to change it she should bring a copy of the document changing her name to the interview.

- You will have to go to this website ---> https://egov.uscis.gov/crisgwi/go?action=offices.type&OfficeLocator.office_type=CIV

type your zip code then look for a civil surgeon near you. You would have to do Medical before you send in all the paper works. The doctor will give it to you in a sealed envelope. If you have all your vaccination records that's better, if not you would have to do vaccinations while you get your TB test done. it would range about 100-200usd depending on the shots you need to get. That is NOT including your medical fee. Medical fee should be ranging between 200-400usd.

Just a few additions.

Having someone not in your household completely do an I-864 is completely fine, and in no way preferable one way or the other in the OP's case because there is zero income already. The only difference between using a household member, as opposed to someone who does not live with you is:

- I-864A - the household members income is ADDED to yours. So if you're only short a couple of thousand, it can be beneficial. If you're short the full amount, then it's must the same as an I-864.

- I-864 - the co-sponsors income must be above the 125% for the household size including the immigrant/s. Their income is not added to yours so it must independently exceed requirements for their household size. So THEIR family plus the immigrant/s.

I also wouldn't waste your time with an infopass appointment. Just read the guides available and ask your questions here. If a USCIS office is close by it certainly can't HURT to visit, but if like me it's 3 hours away, I wouldn't waste your time.

1. hehe. Thank you. Figured it will be a nice way of expressing myself right now.

2. Infopass Question - Base on my Experience, the officer checked my current status (I-94) and then gave me a sheet as to what and how to do the AOS process. They will answer simple questions, I suggest before you go to the appointment, gather all your questions so you don't waste yours and their time. Better yet, there are a lot of people that went through and are going through this process that are willing to help and answer your questions. :)
