K1 vs. K3?

My fiancee is a native of Quebec, Canada. I am a US Citizen. We are currently both students in NYC. I am a med student and she is a grad student.

We became engaged about 2 months ago after dating for 3 years. Now we are wondering what is the most straightforward thing to do. It looks as though the options are K1 or K3? Which is easier? Which involves less paperwork? We ask because we are both very busy being students and do want to go crazy with requirements and forms. Also, my fiancee likes to see her mom in Quebec every few months, and does not want to worry about going home.

Any help would be much appreciated!!!

Visas for for people who want to enter the US. Since your fiance is already in the US - she does not need a visa.

Simply marry and adjust her status from student to resident

Good luck

PS your fiance must have proper authorization to travel once your adjustment of status has begun, please be careful to get the proper documents before she leaves

Yes to canadianwife, but this is a better link: http://www.visajourney.com/content/i130guide2

Once you file AOS, you can't leave the country for a few months, so plan around that.

K-3 is dead, so you can ignore that. K-1 is more expensive... you would file for a visa to enter the country, THEN do AOS. Since she is already here on a valid visa, you can skip the visa to get here. Make sense?

You can ask more questions in the AOS from student, work, and tourist visas forum. Good luck!

AOS for my husband

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!
