Has anyone tried to file EAD before AOS? I am planning to do this and I need some feedback.

You can't file EAD before your AOS. Your EAD WILL be denied if you try this. You need the AOS NOA1 to prove that you can file EAD based on an adjustment of status. If you apply before you have your NOA1 there is no status to base the work permit on. Just file for both at the same time and things should be fine! :D Is there an urgent reason that you want to do this??

As a K3 visa holder yes you can file for a EAD

While holding a valid K-3 (not yet applied for AOS). As a valid K-3 visa holder you may apply for an EAD based solely on this status. You will apply as a category (a)(9), K3 non-immigrant spouse. (Where: by mail -- to Chicago ONLY; not to your local office)

Hi Nakashima,

My hubby, with a K3 visa as well, filed for an EAD without AOS. He got his EAD card in less than 2 months, and his SSN a week after that. Also, the EAD card he got is good for 2 years. Good luck!!!

Thanks for all the response. I'm going to apply for EAD first because AOS is kinda expensive...we have to file for the copy of approval notice (I130) because my husband lost it :D (and it will cost us $200)

We filed for the EAD prior to the AOS and I am glad we did. I have heard that some people have applied for both at the same time, and if an RFE is received, their EAD can be held up because of that. We did receive an RFE for our AOS, and with the baby nearly here, IF my husband's EAD had been held up for any length of time, I think we'd have had to resort to him leaving the country to work until the baby came. Thank goodness it didn't come to that!

-Copy of evidence of admission such as an I-94 (front/back), passport, and K-3 Visa. Use as many of these as possible (I-94 is required); including a copy of the K-3 is recommended. Make clear copies.

- A copy of your last EAD (front and back) if any

- Two passport-type photo's

Are they talking about the k3 form? Or just the NOAs? I am confused :unsure:

It would be a copy of the actual K3 visa on the passport. Also, you don't have to pay the biometrics at this time, you would only need to send the $180 for now. The biometrics fee of $70 will be collected when you file for AOS.

I think that if you file EAD without AOS you do have to pay the biometrics fee, but from the post above it looks like I'm wrong. Odd, because I'm pretty sure that hey need to take your biometrics for EAD, the only reason you don't pay twice if you file AOS is that they take both AOS and EAD biometrics at the same time.

If you file for the EAD prior to the AOS you DO NOT pay for the biometrics to be done. Once you apply for the AOS, at that time you have to do the biometrics again AND pay the fee. Don't know why, but that's the way it was for us.
