Joint Sponsor I-864 for Immigrant Visa Application

Hi everyone! Hope y'all are doing well. I found out, through one of the VJ members here, that in calculating the income of a petitioner who works in the military, only the basic pay (excluding the BAS and BAH) minus the taxes, medicare and social security will be considered. My husband has three dependent children from his previous marriage. Following this formula, he is a little short for the 100% poverty guideline with a household of 5 (himself, his 3 kids, and me). So we consider having a co-sponsor. Now these are my questions:

-I am aware that the co-sponsor should be a domicile in the US. Is it okay if our co-sponsor is living in a different state? He is my brother and an LPR. What should he present to prove that he's a domicile there? Would a copy of his green card be enough?

-As of today we are still waiting for our NOA2. I know that the petitioner's affidavit of support will be submitted to the NVC. Do we also have to submit the co-sponsor's AOS to the NVC too? If yes, will it cost another $88? Can I bring co-sponsor's requirements during the interview instead? On what stage of this entire process that we are required for a co-sponsor?

I will greatly appreciate any information regarding this matter. Thank you so much. :)

It is fine if your co-sponsor lives in a different state. I did a stand alone I-130 so I am not sure how to answer your other questions. Someone else will come along to answer you.

Yes, right now we're trying to do the K3 but I believe what happens recently is the USCIS approve both i130 and i129F at the same time so the NVC will close the i129F once received together so we'll have to apply for CR1. Then NVC will ask the petitioner to pay and submit aos! :P

Yes.

Most USCitizen spouse people submit both at the same time.

If it makes sense to 'wait' then wait until the USCitizen spouse has a COMPLETE AOS package to file.

Yes.

Most USCitizen spouse people submit both at the same time.

If it makes sense to 'wait' then wait until the USCitizen spouse has a COMPLETE AOS package to file.

Okay we will submit it together so there will be two AOS. WHat about the AOS fee? will it double up too?

LPR can be co-sponsor (Include his GC copy). Living at a diff. state is fine. To prove his domicile, his income tax reutrns and GC copy would be good enough.

You need petitioner's I-864 and co-sponsor's I-864 together. There is only one fee for review AOS package which is $88 currently. At NVC stage, you need co-sponsor's AOS too.

My husband and I had our co-sponsor which was my mother in law.

Have your co-sponsor filed out the I-864A and of course he has to submit his Tax Transcript for at least 3 yrs and also anything that would help to boost up the qualification for poverty guidelines.

My husband was still in school that time and never had any Tax transcripts or whatsoever so we solely used my mother in law's income for the Affidavit of support.

-As of today we are still waiting for our NOA2. I know that the petitioner's affidavit of support will be submitted to the NVC. Do we also have to submit the co-sponsor's AOS to the NVC too?

The petitioner will filed out I-864 while the co-sponsor will have to filed out I-864A. This two documents should be submitted altogether to NVC.

No. This is just a supplemental evidence for affidavit of support.

Can I bring co-sponsor's requirements during the interview instead?

Better just submit it together with the IV packet to avoid unnecessary delays.

You already mentioned that your husband was short for the poverty guideline qualification.. You just answered the question.

Thanks Cutie. What I meant by what stage is when we will be asked to submit co-sponsor's documents but someone replied better yet submit it together with my hubbby's AOS to the NVC.

I think my brother, who will be our co-sponsor, will fill up the I-864 since he's living in a different state. I believe I-864A is just used if the petitioner is using the income of a member of his household, i.e. the co-sponsor is living with the petitioner. That's what I found out from reading other websites. Is your mother-in-law living with your husband during the petition process?
