After contacting our congressman to see if he could speed up the processing of my I-102 replacement document for the I-94 I never had we finally received it in the mail and we're now waiting for my Social Security Card to come through.

I've now been in the US for three months and have met the conditions of my K-1 visa by getting married within 90 days, but I have not yet initiated the AoS or EAD applications because - as mentioned beforehand - I am waiting for my SSN and we are also awaiting copies of my wife's tax returns from the IRS (as evidence for the affidavit of support).

Question 1: Do we have to let USCIS know that we are married now that the 90 day period is over and we have not yet initiated the AoS application?

Question 2: Am I eligible to work once I have my SSN, or do I have to have my EAD too?

Question 3: If I am not eligible to work yet then is there any way of getting a temporary work permit that'll enable me to work whilst I'm waiting for the EAD (which I'm assuming will take months for them to process)?

Any help anyone can provide will be much appreciated.

1. No, you do not need to let USCIS know you are married.

2. You are only eligible to work once you have your EAD card, the SSN card is not enough.

3. EAD is usually approved fairly quickly, and you are not able to work until it is.

Mail your AOS and EAD as soon as you receive your IRS documents and hopefully, you will get a speedy approval.

Good news! I received my social security card in the mail today! :D

The bad news (possibly...) is that it looks like I missed my window of opportunity to file the EAD within 90 days of entry to the country, so now I have to wait to file it when I file my AoS (which we won't be able to do until my wife's tax return copy reaches us). Have I got that right? I don't seem to fit into any of the other Eligibility Categories on the form that I can see. :(
