They also asked why I lied on my application! - I answered because I was afraid of not getting a visa.

Is there going to be a problem to get in this time ? (I have a clean record and no charges because of using drugs of any kind)

As far as I understood the officers it was not about that I've tried marijuana, but the fact that I lied about it in my application ... is this correct ?

You admitted that you misstated a material fact for the purpose of obtaining a visa.......FRAUD. :bonk:

As other posters have told you, lying to US Government officials is a HUGE no-no and can carry a lifetime ban.

But in germany, at least amsterdam, smoking marijuana is legal.

Amsterdam is in the Netherlands.

so if I apply for a new visa, do I really need a non immigrant waiver, if I present the case that it was a misunderstanding and I didn't knowingly lie on that application ? If I do need a waiver I heard it could take up to 2 month to get one, will I be able to have my passport to go to canada to do the travel and work program ?

I understand that right now it is going to be very unlikely to travel to the states, but I am thankful for all the kind help and informations from you!

Were you smoking weed before you answered the questions on the application? Honesty is always the best policy (well in most cases) BUT for immigration, it's a huge thing. With these addresses to these "Farms," why have them? Maybe more we don't know about your A.True intention to coming over, and B.reasoning for asking how to maneuvering your way through the US system. Do the application, tell them what happened, be honest then, now, and for the future.

The US already has enough liars, we don't need anymore.

But in germany, at least amsterdam, smoking marijuana is legal. He should have just said yes he smoked in areas in which it was legal, but checked no, meaning he had no convictions

I would venture to guess the person that interviewed him was just an #######

Amsterdam is in the Netherlands, not in Germany.. they're both places in Europe but that's about it.

Smoking marijuana, even in countries where it's legal is STILL an issue. It's illegal in the US, it's illegal to have "done it". Otherwise the immunisation rules would be redundant.. I mean my country doesn't have rabies for instance, but because I want to enter the US, my dog would be required to follow the US laws and have a rabies shot and NOT have rabies... the same applies with the drugs, he's not allowed to have done them, at all... at least that they know about or can prove.

Amsterdam is not a country. It's the capital city of a country called The Netherlands, sometimes referred to as Holland. smh

Well just do make some things right, I did not intend to work in the us but in canada (where I had a work permit). However I think i will wait for a while before trying to enter the us... some of u were talking about life time ban because of the lying "fraud", so why didn't they give me a lifetime or 5 year ban if I won*t be avbkle to go to the states?

I now will enter canada for that travel and work program, as intended, but since the officers will see that withdrawn visa in my passport, they probably gonna ask some questions at the border right?! telling them i got rejected to the states, because I lied about drug use would probably end in not getting into canada right ?

Does anyone know if canada has the possibility to access the us database to le3arn about my case ?!

If anybody has any advice that would help to at least do the work and travelk program in canada, i would be very thankful.

For the intellectually challenged or confused: the US operates under US laws.

If it's okay in Thailand to have sex with a 14 year-old, and the US authorities find out about you doing it, even in Thailand, you're going to jail in the US. That happened to a physician lately who got caught by a camera crew investigating this. He lost his license and is in jail.

If you smoke pot in Amsterdam, where it's legal (in certain locations), and a US D.A. can prove you did, you're being prosecuted for it in the US for it.

Prostitution is legal in Germany, but if a US D.A. can prove that you had fun with some hot chick and actually paid for it, he can prosecute you for it in the US.

I personally think not all of this makes sense, but where do you draw the line? Sex with 16 year-old okay (age of consent in many countries), or 15? 14? 12? Who can be the judge? Who's right? That's why US law is applied to people who are under the authority of it, and a tourist applying for admission to the US is under authority of US law.

I don't even smoke cigarettes, but I'm a supporter of Prop.19. Let's take the crime out of smoking a joint at home. Just because alcohol is legal doesn't mean that everybody is getting wasted every night. It will be the same with pot.

Started drinking at 18, actually a bit before then to make it even worse.

Canada and the US share information. They can -- and will -- dig it up if you give them reason to suspect you of anything.

The CBP (Customs & Border Protection) has a great FAQ utility. They also have a great suggestion for those who are unsure what the withdrawal of entry means to them. Pay particular attention to the last paragraph:

"In some cases, you may not be sure how to answer this question because you were "allowed to withdraw" your application for entry, or a U.S. Consulate declined to issue you a visa because you did not have enough paperwork for them to make a decision on whether or not to grant you a visa. If this is your situation, we advise you to contact a U.S. Consulate and discuss what happened and ask them to tell you whether or not the withdrawal or declining to issue a visa constitutes an actual denial of entry or visa."

You would be prosecuted for the other crimes (travelling to solicit prostitution or sex with a minor) because it's specifically addressed as part of the US criminal code.

Currently before congress is H.R. 5231, a proposed amendment to the controlled substance act, which would allow a US prosecutor to seek charges for using illegal drugs in a foreign country even if it is legal to do so based on that countries laws. AFAIK is hasn't passed yet but it is expected to. The intent is not to catch recreational pot smokers but it would give the authority to do so.

So if I go to the border of canada to get in on my work and travel visa, I will be asked questions like everyone else is... " how long are u staying?" and so on...

I am going to have a new passport with no B1/2 denial stamp in it. So if the canadian officer asks me if I ever got denied entrance to any country and I say NO... will he be able to see in his computer that in fact I did get denied entrance to the us ?
