That would be so wonderful if you can be with him on your anniversary. But much better the soonest possible time. I know the feeling of being far away from each other. It's tormenting our souls! *sigh* Goodluck Mrs. D. Hoping you can be with him very soon :)

see this post scared me S#%^less,because on our embassy's website,they mention they only require the last years tax return,which we have,however i have heard its normal for them to require 3 years prior,thats where our problem begins,SO wasnt eligible to file for taxes in 07

ive been wondering about whether or not we will have to get a cosponsor,but still,this post REALLY scared me and brought it up

I know how you feel. My husband keeps on reminding me not to worry but I can't help it. What I can advice for you though is be prepared. Compile all those documents that are required by your embassy but try to get the other documents as well in case they ask any. Like Mrs. D said, it differs from embassy to embassy and from person to person. You'd like to think of who could possibly your joint sponsor just in case they ask you to have one. Do what you can do now. It's good that we are here so we can help each other out by providing information that could really help us.

oh i know,i know very well about men thinking stressing is silly or just something that can easily be controlled:-J

i made SO email both ankara embassy and the military hotline and is supposed to try to call em tonight or tomorrow morning.

i dont wanna think about the possibility of having to get a joint sponsor cause i know how big of a responsibility it is.

i dk,we will see,i really hope we wont need a co sponsor

In our case, hubz decided to listen to the lawyer and not his wife, that's why we got RFEd on the interview! :P I simply knew they were gonna ask for a joint sponsor but he wouldn't trust me..

Anyways, I agree - you should see who can be ur joint sponsor just in case. If they don't ask for one - good! :) But if they do - it would be awesome if u have all the necessary dox AT the interview, so you can just give them more paper to have fun with! And don't stress too much - all of this is just bureaucracy! :bonk:

Okay, I think I can clear up a few of the questions on here.

MILITARY PAY:

When figuring income for Affidavit of Support, only taxable income is allowed, so only BASE PAY is used to calculate. I am Active Duty AF, and just recently passed this portion of my wife's process. All was well, even though I was deployed 5 months last year, I still met the 125% threshold. :whistle:

CHILDREN:

I have 3 children with my ex-wife. She has custody, but I claim 2 on my taxes every year based on the amount of support I provide. Those 2 children are included in my household size. Rule of thumb: If you claim them as a deduction on your tax return, they are a member of your household, whether or not they live with you.

As for the OPs RFE, I have always assumed that the current years income is what matters when it comes to the I-134. He can take his LES, take his base pay, and multiply it by 12. That will be his GROSS income. NET income is minus taxes, social security, and medicare. If he is military, all of these can be found on the LES.

On another note, the amount they want from previous years tax returns is the adjusted gross income. Which is the total taxable amount from line 37 of IRS Form 1040, or subsequent lines from other 1040 forms. Look for the bold heading TOTAL ADJUSTED GROSS INCOME.

The reason they look at past years is to show income history. Past years income has NO bearing on the affidavit of support. ONLY current years income.

so you mean that IF we get a 221G to add a co sponsor,it wont be because of my partners tax status in 07?

in other words it wont have an impact?

And by the way, US Embassy Manila will require 3 previous years tax returns or transcripts. I used all transcripts...they're easier to read.

It should have zero impact. Current incomoe is all that is considered for poverty guidelines. It states this on the I-134/I-864.

And another note for the military folks....we are only required to meet 100% of the poverty guidelines....because the government realizes that we don't make as much as our civilian counterparts.

It will only if you are using your partner's income combined to make up the 125%.

And another note for the military folks....we are only required to meet 100% of the poverty guidelines....because the government realizes that we don't make as much as our civilian counterparts.

im sorry,im a bit stupid when it comes to american taxing system.

there is the possibility of adding all three prior years income to meet 125%?

because as far as i know,apart from 07,he has met the poverty guideline ( 100% need for armed forces that is )

No, all 3 years are not combined. I am assuming that he used his allowances when figuring his income. Only his base pay is used to calculate total income for the year. If he still meets the 100% guideline, have him re-submit the I-134 with the new numbers, and his tax returns/transcripts. I also included previous 6 months worth of LES.

You're welcome. Just be aware that if he falls below the 100% level, he will need a co-sponsor.
