One other thing I forgot. When calculating, you need to subtract all of his deductions on his LES for Federal, and State taxes, sosial security tax, and medicare tax. I hope he still falls above. PM me if you need help.

well for a family of three which is aour petitioner plus the 4 of us immigrants so what would be the poverty guideline or what is the exact income requirement?

I AM RETIRED U.S. NAVY, SO I REQUIRE 125%. GOOGLE I-864P FOR THE INCOME REQUIREMENTS TABLE

It should have zero impact. Current incomoe is all that is considered for poverty guidelines. It states this on the I-134/I-864.

And another note for the military folks....we are only required to meet 100% of the poverty guidelines....because the government realizes that we don't make as much as our civilian counterparts.

Sorry to disagree with you, but my interview was on the 21st and the USEM told me they will issue my visa when they receive co-sponsor dox package... LES, W2s, Turbotax and IRS transcripts provided, copy of enlistment contract (showing 3 years left), current yearly income as of Aug 2009 - 36k... Like I said - varies from USEM to USEM and person to person...

i have also heard that the only reason having three years prior isnt mandatory they only request it to make sure its not a new or one year thing.it also depends on the consulate as well.

if i were you i would have send them everything but the Cosponsor paperwork and explain that you are well above the guideline.

PS: allow me to add this from our consulate's packet 3: 7. EVIDENCE OF FINANCIAL SUPPORT: K-1/K-2 principal and derivative applicants are subject to INA 212(a)(4) and must demonstrate to the consular officer's satisfaction that they will not become a public charge. The enclosed information sheet, Optional Form 167, lists evidence, which may be presented to meet this requirement of law. The affidavit of support to be submitted must be Form I-134 and must be accompanied by the most recent year’s tax return form. AND at least for ankara embassy,i-134,W-2 and 1040 and the most recent years tax return is a MUST.so i would have the right to pressure them if they request the same thing

We did send them everything!!! And on hubz enlistment contract it says he has 3 years of service left... Idk, must be a bulgarian consulate thing..

Okay so reading Filipinawife0210's posts make me worry again. Need to ask hubby to calculate again. If he falls below the threshold, what form that should be used for the co-sponsor? On what stage do we need this form, NVC stage or during the interview?

during the interview,and from what i have gathered : (if you are not qualified to sponsor your relative financially, you must find a co-sponsor who can present a Notarized Form I-134 and supplemental documents in addition to your Affidavit of Support. Also you must prepare a statement explaining why you did not pay any taxes to the U.S. Government during the last taxable year).

of course minus the tax part since you wont have to get a sponsor because of tax problems
