Hi there everyone,

I was just thinking.

I came here June 11, the POE IO gave me 6 months so my tourist visa expires on December 10. I applied for AOS october. If I don't have any approval or any news about my AOS application do I have to leave the country or apply for extend of tourist visa?

I just don't want to be staying here illegally so the question just popped up in my mind.

4/29/2016 (Day 10) - Biometrics Scheduled

USCIS grants you a period of authorized stay while the AOS application is being adjudicated. This period of authorized stay begins when USCIS accepts your AOS application, which is the day they send the I-797C "Receipt Notice". The period of authorized stay ends if the AOS is denied, in which case you'd be given a limited period of time to voluntarily leave the US. If your AOS is approved then your green card establishes your lawful presence.

Some people think they have to leave the US if their I-94 expires while they're waiting for the AOS application to be approved. Not only is this not true, it would have dire consequences. The AOS application is considered abandoned if you leave the US without first obtaining advance parole.

05/01/2013 - Removal of Conditions - APPROVED!
