My daughter and her now husband got married on Maui, Hawaii, while on vacation there.

Both needed their passports when applying for the marriage license--issued immediately--and they had to state that they are "free to marry" which means nothing else than that they are not already married. If you both are 18 years or older, that's all that's needed.
