Re: Secondary evidences

It all depends on from which country the beneficiary is from and the level of fraud etc. Some countries will be harder hit than others in terms of secondary evidences, hence the phrase "how bigger is mine than others" for the evidences :star:

To me - relatively low fraud country, I included the below secondary evidences in addition to the marriage certificate:

1) Two affidavits signed and notarized by my parents

2) Birth certificate of our daughter (But when we did first time, didn't include daughter's doc since we were NEWLY married :star: and the ink on the marriage certificate still smelled fresh!)

We've only been married for 11 days...although our relationship began well back into last year...but how come our lawyer hasn't asked for any of this? He has been really thorough in getting all the documents ready so we can file, but never has asked for anything evidence related....should I put my husband's name on my house? Is all this evidence really needed right now? I am stressing. I just want this FILED so I can hunker down and settle in for the wait.....:blush:

When the US citizen lives in America and the foreign citizen lives abroad and they have only just gotten married, obviously USCIS understand that you won't have much, if any, co-mingling of financial resources. However if there is any evidence of joint finances then do include that. Also, you should include three affidavits from friends/family who have knowledge of your relationship. Recently they have started to request these from any newly-weds who don't provide them. These don't have to be anything extravagant. (Also, if either of you have been divorced recently then you may want to include an affidavit explaining the end of that relationship. These have also been requested recently by the London Embassy.)

You can look into putting your husband's name on the house, but don't worry if it doesn't get done before you send off the I-130.

Experienced lawyers are helpful in very complicated cases, for example when there are crimes or the such involved. However, they are not always aware of what is happening on the ground in the immigration offices and Embassies right now. For example, affidavits didn't used to be requested but now they do seem to be asked for if not given. He might not know that, but forum trawlers will :D

My name is Deb, from Arizona, and just last week married whom I believe to be the most wonderful man in the world, who is a citizen of England. We are going through a lawyer to assist with all of the steps to get him here, to the US, so we can truly start our life together. However, going through a lawyer is still completely confusing to me, so I'll be around here a bunch maybe asking questions and looking for teachers of patience ;) We are in the final stages of collecting the last of the documents needed for the I-130, then I guess it goes to a K-3 visa from there? Our lawyer has done his best to explain the process to us, but its still overwhelming...and even though he just left only 5 days ago to return to England, I am terribly impatient and while I realize this could all take up to a year, I am missing him terribly. But I guess we are all going through the same things...which is why I am really, really happy to be here! I'll be going to England in March to visit him, but in the meantime, I am hoping to learn, find peace and sanity, and hopefully remain optimistic for all of our sakes :)

My main frustration right now is that the I-130 won't even be able to be filed for a few more weeks, so I have a feeling its going to be a looooong time for all of this...but I'm committed to him, the process, and making the best of the time between now and him stepping of the plane here in the US for good.

I feel your frustrations. I, too was once in your shoes, but patience is a virtue.

I hope everything turns out perfectly between you and your man, plus the visa process.

This process is tedious so just be optimistic.

You sound exactly like me except about 3 weeks behind me... we might be taking this ride together! :thumbs: I just got married a little over a month ago, he's gone back to Canada and I am almost finished putting together the I-130!! I would love to agree and emphasize with the others here... you really DO NOT NEED a lawyer. If you can read, follow a checklist, and aren't afraid to ask questions on here, then you can do this yourself and perhaps save yourself some time! That being said...

Thanks again for all the responses...I hadn't been around to read them because honestly, I was trying to stay away from here until the I-130 was filed...it was only frustrating me more ;) I was having trouble tracking down my divorce decree, but I was told by my lawyer that he found it, and we are ready to file...so hopefully that will get done quickly...and I can hang around here more now :thumbs:I really appreciate the warm welcomes, thank you so much! (L)
