hi.

i need to ask as i am feeling so lost.

i am in the uk and my hubby is in usa and we filed the I-130 - 34 days ago now. we had the NOA1 about 10 days after and now we wait...but for how long til something else happens?? is the USCIS process the longest part of this? the I-130 is all we have done.

we are applying for a IR1 visa, we have been married longer than 2 years.

everything with our application should be straightforward and i am getting the forms/police cert and other things sorted on this side ready for the next part...

the last touch of our application was the 17th september...i think they pushed it down the back of the desk and it dropped it on the floor and kicked it under the desk where it now sits, as lost as me!

i asked my hubby to call USCIS but he says he will only get someone looking at a computer screen and seeing the same as what we can see on the 'status page' of USCIS website....like the last time he called them regarding the initial RFE we had (which is now sorted)

is there anyway we can find out exactly what is happeneing?

this is driving me nuts.

its driving him nuts.

and its driving everyone around us NUTS!

I think you should not have waited so long to file? You guys have been married quite awhile. Oh well sit back and wait and wait some more. It took me 7 1/2 months to get through the USCIS. Now I am waiting on the NVC 2 weeks so far. . Good luck but plan on a 3 month wait for the Uscis. I planned on a year for the CR1 from everything I read. Some made it in 5 months start to finish. Lucky them unlucky me. I also know they won't even look at your file until after 5 months +1. So I called right at the 6 month mark and that's when I got some action. I called at 5 months they told me to call back in 1 month.

hi,

my hubby spoke to someone at USCIS before we sent in our new and corrected I-130, she just told him to resubmit a new form, the old one was disregarded. (it was an address issue) he got her name.

the evidence we sent with the I-130 was,

a cover letter

a copy of the email i sent to the US embassy in london asking what we need to do, and their reply.

another letter telling them of our situation and how we got into this mess.

a copy of the I-797 NOA1

my birth certificate, my husbands birth certificate.

G-325 from both of us.

a copy of the K1 visa in my old passport (i got a new one when i returned to the UK - changed to my married name :D )

a copy of biographics page on my new passport.

a copy of the biographics page on my hubbys passport

passport photos

a copy of my SSI card

a copy of our marriage certificate.

a copy of my hubbys late wifes death certificate

a cheque for $355

we also sent in 4 photos of us together.

we basically used the guide here on VJ and packaged it up without staples or pins. the passport phots from the original submission were returned in little plastic bags where they had written P and B on them, we just returned them as is.

my attitude about immigration from the UK (sorry folks - lmao) is that stuff the declaration of independence - the majority of Yanks originate from the UK and throwing all your TEA into the sea doesnt make you no longer originally british...why cant we brits just walk in!! haha

my hubby is coming over to the UK in january...i cant wait. :)

we did talk about an expedite, but i feel the same as you...a failed one will make this a longer wait.

my hubby currently has his mum looking after...or should i say - running around after his two teenage girls, she is in her 70s and has health issues, really she should be enjoying her grand children and not being hassled with attitude. my husband is self employed and should anything happen then he is not able to work because he needs to take care of his children.

through all this they are suffering too.

thanks for that link, i knew there was something like this here...i remember it from our K1 procedure, i had a quick look at it yesterday, but work got in the way...

we use MSN, my internet package gives me free international calls and over the passed year i have topped up well over £1000 on my mobile.

there isnt much about communication connections that we dont know, lol...been in this crappy box for the passed 6 years now....I WANT OUT!

it is a longish story, which i wont make this repsonse here longer than is needed...lol

i am british, we danced the K1 visa process in 2007, i went over to the usa be with my hubby in jan 2008, we married in march 2008, 18 month later (june 2009) i returned to the UK, one of a couple of reasons - my dad was ill, he since died, we wrote here asking advise and some responses we were told i may be banned for up to 10 years, we had to do DCF, and a lot of other bad advice, instead of jumping straight on the USCIS wagon, we stalled, we didnt know what to do, the whole thing was confusing, i had to get a job and somewhere to live after my dad died because i didnt know how long i would be here...as they say - we carry on!

money played a factor, we are both scraping by the best we can.

for the K1 we got a lawyer, who wasnt worth the time of day - he didnt even know i had my visa...just filed the initial petition, went OVERBOARD with it!! and sat back sending out bills to my hubby. personally i wouldnt recommend a lawyer or an 'immigration specialist' to anyone, unless they are REALLY good and have an excellent TRACK RECORD!...with a little hard work and a lot of reading you can find out anything on three main sites - USCIS, travel.gov and the US embassy site for your country... (my problem is i like to know what 'real people' think or are going through with this process)

i remember the K1 process took in total 9 months, i was hoping that the IR1 took less time, with the marriage side already being done

i married a yank - i want to go home!!!!! NOW!!! they already have the K1 stuff and it (should be) linked up to the IR1 stuff...where it the frikin problem?? USCIS get with the frikin program already!!! lmao

thankyou everyone else for your responses...just taking the time to read and reply means a lot to me.... :)

i wish everyone a speeeeeedy process and good luck with everything you do. (give them hell!! lol) :bonk:

erm...i am not freaking out...we have done this merry dance before, with the K1 in 2007. i know all too well this is a waiting game...i was enquiring if the USCIS was the longest part of the wait with the IR1and giving an insight into how i am feeling...

2004 - we met online.

7th May 2007 - filed I-129 paperwork

9th June 2007 - received I-797 notice of action

13th November 2007 - I-129 approved

18th December 2007 Visa and medical interview

12th January 2008- Shipping company arrived

14th January 2008 - landed at Newark Airport.

9th March 2008 - got married(received SSI number)

April 2008 - My things arrived in USA from the UK

9th March 2009 - our 1st Anniversary

14th June 2009 - returned to the UK

9th March 2010 - our 2nd Anniversary - spent apart - so lonely :(

1st September 2010 - filed I-130 (applying for IR1)

11th Sept - Received I-797c address part C error

13th Sept - Resubmitted I-130

24th Sept 2010 received second I-797 NOA status - "initial review"

4th January 2011 - I-130 Approved - moving to NVC!

12th January 2011 - I-130 forwarded to NVC.

31st January 2011 - Notification of LDN number received in the post.
