A littled concerned.

My application is still at the stage of initial review.

and you should be. You must stay in the US at least 6 months of every year. There are special circumstances like work, etc. that can give you a pass. But even if you receive a 10-year green card and you don't reside in the US enough days - one day when you try to come back and the card can be revoked. I myself witnessed a similar situation at the airport. But of course, every case is different.

Of course it does matter. You are saying that you live out of the US while you are applying for a 10 years card to reside here in the US. If you are request for an interview consider how you are going to explain this inconsistence. Bottom line is that you reside in a country or you don’t.

Can you clarify what "I live outside the US" means?

If you actually live/reside outside of the US then the term Permanent "Resident" does not apply....and there is nothing to apply for, or no Conditions of "Residency" to Remove if you don't "reside" in the US. I think you will have a major problem.

I returned stateside from an Overseas trip last month and was send to secondary, a usual. While waiting for my turn, I witnessed one couple to be stripped of their Green Cards because they had not fulfilled the residency requirements. It's instant and it is tough. Those requirements need to be taken extremely serious.

Well, it's a temp thing. I will return to the U.S. early 2011.

How long have you been living outside the US. You will have to apply for reentry permit if it has been more then 6 months!

Actually you should apply for a re-entry permit if you'll be out of the US for over 12 months. Any absence of over 6 months will get scrutiny at POE.

BTW, the re-entry permit is to be applied for prior to your departure.


Must have info for bringing your Philippine wife/fiancee's child to the US

Is it possible to apply the permit in overseas embassy?

No. Must be applied for in the US (the re-entry permit that is).

Re-entry permit is only required after TWELVE months, not 6 as stated.

I don't know but it seems like you don't care that much about it - if you haven't checked all the details before your trip. Or you are just a free spirit guy and I can envy you just for that.

You are right. I didn't plan ahead. I didn't feel like to be tied down. But I have to admit that we are all being tied dowm in some way.
