thank you all so much for your input, well i went to Social security office to get a name change but i was told i have a out of the country marriage license and will not accept that until i legally change my name in court. so yesterday i went to court and was told that they will need me to get a marriage license in U.S, well inother to do that my husband will have to be here. Also tried DSP and was told that my SSC needs to be change first before my driver's license can change.... well that is my story so far... i guess i will not be able to change my name afterall...... so why is out of the country marriage license not considered a marriage license in the United States?

Lizzye...that's crazy. I (USC petitioner) changed my name at the Social Security office with just the Nigerian marriage certificate and whatever other documents they required, i.e., birth certificate, and my husband definitely wasn't here yet. I didn't have to change my name in court either. That is true though about the driver's license. I couldn't change that until the social security office changed it.

Lizzye...that's crazy. I (USC petitioner) changed my name at the Social Security office with just the Nigerian marriage certificate and whatever other documents they required, i.e., birth certificate, and my husband definitely wasn't here yet. I didn't have to change my name in court either. That is true though about the driver's license. I couldn't change that until the social security office changed it.

Maybe call the national number and ask them (1-800-772-1213) or go back to the office and ask for a supervisor.

sounds like you spoke with a dummy. if you are legally married in ANY country and bring that documentation in, you can change your name.

Actually this isn't always the case. It isn't in Australia so I can only assume that sometimes the same applies to the US (with all the random rules in some states you never know). In order to change my name here in Australia based on my US marriage certificate I had to change my name with Births, Deaths & Marriages first (which included a lovely fee).

Basically what i'm saying is maybe it's the same with your marriage certficiate. While Australia "recognises" my marriage certificate, I can't change my name on "legal stuff" without the name change certificate (I could change my bank account no probs).

Maybe go to the local courthouse and ask their opinion. Maybe the same rule applies.

In high fraud consulates they look for signs that a marriage is not real. If you had been paid to help someone come to the US you would be less apt to disrupt your existing life. However there is no written requirement. In the highest fraud consulate ( Lagos Nigeria ) you should be very aware of the traditions of the tribe you are from becaise they love throwing that in as a reason to deny.

This will not be over quickly. You will not enjoy this.

I didn't change my name until, wow, maybe 2 years after he was here. My last name vs his had no bearing on the end result of him getting his (at the time) CR-1. It would be a shame if your use of your maiden name had an impact on your petition, they always ask for it on pretty much every friggin form anyway!

all i know is that the SSA website specifically says that you can bring in your marriage license as proof if you want to change your name. if it was good enough for USCIS, the NVC, and the particular consulate you go through, it's good enough for the SSA.

That's funny because I almost couldn't change it at my job, they weren't sure about the foreign marriage certificate...until I reminded them that the SSA accepted it just fine :D
