Question about divorce

Hi All,

I'm not sure if i'm posting my question in the right place?! if it's not the case please advise where to post it in this forum.

I'm a GC holder and my husband a US Citizen. we got married in Morocco, then I came to USA 3 and 1/2 years ago on a K3 visa. I got my 10 years GC last year. We have a kid from our marriage. I'm eligible to apply for citizenship, but for some problems, i didn't.

Question: I'm going through difficult time in my couple life. I'm thinking of filing for separation/divorce. where should I do it? should I file in Morocco (place of marriage)? Or it's possible to file in USA (Louisiana) if I want?

Please advise.

You file in LA, in the Parrish where you live.

Do not even try to in Morocco, unless you are living there and cannot use a LA court, especially if you want child support.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Desert-fox: do you have an idea about how long does the divorce process take?, is there any reason behind your saying: "don't even try in Morocco..."?? is it difficult there? or for something else?

First of all, you live in LA. They have jurisdiction in this matter. I t doenst matter where you were married. You file in the court where you live.

La, like all states, follow the American practice that kids come first, and that they deserve to be loved and supported by both parents. That a priority is for the welfare of the kids, and that changes to their lifes should be minimal. You will need help from you soon to be ex, in helping with the support of the kids, and that he should be involved. Part of this resonsibility is paying child support should he earn more money than you.

With a LA court order, it is an easy matter to return to court if he fails to live up to his obligations. They will enforce the court order if necessary by attaching his wages.

You would not have this protection should you have a divorce from some court in Morocco. Im not even sure if a LA court would even enforce it, since you live in their jurisdiction, before and after the divorce. I would think before you could use a court in Morocco, you have to be a resident within their jurisdiction. So unless you plan on living there, why bother even trying???
