confused about schedule on uscis

Now I have to post again because I am really confused.

According to uscis csc is working on filed with the receipt date of march 06 2006.

Now I read that many people got their NOA2 approved eventhough their NOA is may 06 or later.

How is it possible? Of course it is great if this is that way!

Everything is so confusing!

CSC isnt even bothering updating the processing time because they are no longer going by that date. Sorry.

I don't think you understand. There is a new law called IMBRA. It went into effect on March 6. Because of that everyone that filed between March 6 and when they came out with a revised I-129F form had to get a RFE for more information. Because there was a 3 month time where no petitions were being processed they are backlogged like crazy. They just stopped going by the NOA1 dates and are doing them at random. There is just no way to know when they will get to your petiton. The posted dates mean nothing.

What does IMBRA means? Is it a good sign if there is nothing coming in the mail since the NOA?

IMBRA stands for International Marriage Broker Regulation Act. In essence it requires anyone (not just those using a marriage broker) filing a fiance visa to disclose several things.

1. Did you meet via a Marrage Broker? i.e. a web site that charges the USC for contact info of someone from another country.

2. Does the USC have a prior criminal background? If so the fiance must be notified of that history.

3. How many prior I-129F petitions has the USC filed before. They are now limiting the number of petitions that can be filed without seeking a waiver.

If you used the new form those questions would have been on it. If so you shouldn't get a RFE for that info and your chances of getting an approval in a relativly short time is good. If you used the old form that didn't have those questions on it you will get a RFE for that information. That is why they are so backlogged right now. They had to send out more than 10,000 RFE's and they are still not done with that. In the 3 months they did nothing the cases just piled up creating a real nightmare for all of us. My petition was filed on March 13 and I still have no NOA2 as of yet. Others have gotten theirs and still others are still waiting for their RFE's. It's a real mess.

I just looked up at the I-129F Form we filed and could not find anything about IMBRA.

So it looks like this was the wrong form.

Do we have to wait until they give us a note of the wrong form or can we go ahead and send the right one?

Sorry, you got to wait until they ask for it. The RFE they send you has your name and case number on it and anything else you send them will be ignored.

this is really upsetting. Maybe it would not be too bad if my fiance won't be deployed by end of this year for 6 months which will cause a even longer waiting time and maybe more problems
