Question about my fiances son: Do we need a notarized permision for the kids biological dad to be able to come here with my fiance?

Hi...here is information regarding travel clearance of a minor in the Philippines:

"A travel clearance from the DSWD is not required by a minor traveling to a foreign country with both or either parents or with his/her solo parent or legal guardian. ". So, your fiance can bring her son without a travel clearance since her son is traveling with her..as amended

that requirement shows what the government of the Philippines requires for minor children to travel abroad. It is not what the US consulate will require to give a visa. You will need either consent of the father or a court order.

Doesn't the OP's fiancee have full custody of her son as stated in her Declaration of Finality of Absolute Nullity of Marriage? Wouldn't this suffice? In my case, I do have full custody of my minor daughter as stated in the Court Decision (Annulment). I also have a Permanent Protection Order relative to R.A. 9262 (Violence Against Women and Their Children Act of 2004) granting me full custody of my daughter; my ex is not allowed by the court to come near us (including my 2 other children) within 200 meters nor even communicate to us directly or indirectly. Would the Consulate still require me to ask the consent of my daughter's father?

I have no idea what their document says, they didn't mention it. Is the full custody statement enough for the consulate? ... You would have to ask the consulate. Is a Protective Order adequate? ... You would have to ask the consulate. In any event, the reason for not needing the father's consent would not be the link you provided. The legal documents that you have may be valid alternatives. What I previously stated was that either the father's consent or a court order would be required. It appears that you may have the requisite order depending on what the consulate accepts. I do not know the nature or wording of what the OP has. Just because a marriage is annulled doesn't mean a father gives up all rights to his children.

Luz has a son that will be coming over with her. I asked my lawyer about what is needed to bring him. In our case his fathers name is not on the BC even though they were married at the time. That gives us our "out". But my lawyer did tell me that if there is a father listed on the BC his permission or a court order is needed to get past the PI immagration. Having full custody isn't enough.

If it works anything like it does in Brazil, I guess that if the father hasn't lost or given up his parental rights, then he needs to sign some sort of document authorizing his child to go to the U.S.

I only offer advice - not even legal. Just the plain and simple kind.

Yes, my fiance does have full custody of her son. When her son was born, they weren't married yet. So on the BC, it doesn't state that she's married, however, she told me that on the back of the BC, the father did sign it... My fiance will be calling the consulate in manila today and will be asking about the requierments for her son to be able to come with her.
