K1 denied---please help

Almost forgot....as for DOS saying the case is still in review...the consolate can deny giving a visa, but they can't deny the actual petition without the Service Center (CSC or VSC) also denying it. So they send the case back with the 221(g) recommending that the service center revoke the original NOA2 approval. There r usually a few things that can happen with these cases: u can stop it & get it reopened at the consulate (VERY rare), the service center will review the case & send u a NOID so u can rebuttle the case (and they decide to deny or reaffirm), you can go get married (which will make the K1 useless, but the reason for the denial can still come back when u file for CR1), or they will just let the case expire (at while time u can refile the K1, or get married & file CR1...but the reason for the original denial will probably still be brought up). Hope that's not too confusing. This whole process is crazy.

Glad to help. As for doing the NOID...well i was luck to get it from CSC to start with & also I had just gotten back from spending 3.5 mths there with my daughter & couldn't afford to go right back to get married, so we figured we'd wait & see what happened with our case & we got lucky enough to get the NOID & able to rebuttle. As for the NOID being denied..from what I read by Marc Ellis, a pc6 marker (fraud marker) is put on the case when refused at the consulate & if the Service Center also denies the case (in other words, agrees with the consulates findings), the pc6 marker is found to be valid & so bans entrance in to the US. I read that you can try to fight the pc6, but its very difficult. I just rather not think about it though. Focus on what you do have control over. The questions should show u the exact reasons for the denial. I wrote a rebuttle letter just based on the interview questions & when i received the NOID, the exact reasons were exactly what I thought they would be. Did your fiance ask why they denied him?

Just got off phone with dept of state. According to them, a 212g means a decison has not been made, the case is still under review. She said there is nothing in the computer that states our visa was denied......could still be denied but as of right now it is still under review. Any experience or comments???

This happen to us..... Contacting my Senator did nothing for us. We recently got a letter saying our petition was closed because the dates expired.... I have visited twice in the last year the 1st. time for 3 weeks the second time for 5 weeks... I was actually in Morocco when he went for his interview...... Anyhoo we are just gonna marry there and file for the CR-1 Insha'allah all will go well.... I suggest you go back and marry there and file the CR-1

I'd have to agree with an earlier post that only spending a little more than 2 weeks in Morocco is a huge issue when dealing with Casablanca. I would suggest that you return to Morocco, and spend as much time there with your fiance as you can, whether you marry or not. It can only help in your future efforts to bring him to the US. Speaking from personal experience.

Hi,

It is quite unfortunate to hear that, my advise to you is to email the US Consulate to find out if they can give you a concrete reason for denial or if the referral letter issued to your fiancee after the interview states the reason for denial,and you feel that the denial did not worth it, Contact the US Consulate in Morroco via email and plead with them to review your case again and change their decision before the case is being returned back for revocation .

Having been to the US Consulate in Morroco more than 2 times on a Visitors Visa has nothing to do with the denial unless the Consulars Officers discover there is alot of inconsistencies between the statement of the fact she submitted in the application previously on a Visitors Visa different from the application in the Immigrant Visa.

If they insist of returning the case back, my advise to you is hire a good Immigration Attorney who specialises in returned immigration cases for revocation to handle the petition, Do not file another one unless you feel that the reason for revocation is substanial if known to you, But if not known to you and you are not aware of the reason for returning the petition then allow the Immigration Attorney to handle it perfectly and argue with them based on the point of Law.

You should not worry , Continue to email the Consulate to know if they can change their mind and grant your request to review your petition back again and take a favourable decision.

K1 was denied in Casablanca Morocco today. I have been to Morocco 2 times in the last 6 months. My fiance brought all the necessary evidence but was still denied. We are thinking he was denied today because he applied for a visitor visa about 2 years ago and was denied. PLEASE PLEASE PLEASE if anyone can guide us on what to do now......we feel helpless and don't know where to start!!!!
