what if my finacee is pregnant?

There is a chance that my fiancee may be pregnant. We still havent started the k1 process. right now she is back to her home country and we would really appreciate any advice u may have for us. Thank you for ur help

That may depend on why you have yet to file.

It won't affect the visa process in terms of making it quicker, just that your household will get bigger by one for the affidavit of support.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Congrats to be......nothing can be done immigration-wise. That process runs at it's own pace and you can't do anything about it.

Can we go with the K1 process despite the fact that she might be pregnant or do we need to get married and go with spouse visa? How all this may affect the child? We are not looking into speeding the process or anything like that, we are just looking for the best solution because we are afraid things may get complicated if she is pregnant. We were ready to go with the K1 but now... we are on standby, so i am simply exploring and covering the bases.

No, the K-1 is fine. Getting married is OK also but normally takes a bit longer than the K-1. If she has the baby(s!!) before the interview, then you will need to show that additional financial support. The stickiest part would be if she had the interview and then gave birth over there before coming here on the visa. I say full speed ahead, and why not ask for an expedite; it won't hurt.

You still have the choice of going with the fiancee visa or choose to get married. Yet, your child might very well be born before your fiancee is able to get her visa. In which case, you need to prove that you make enough money for a household of 3 (that is if you do not have other children to support). Then, you would also need to file for your child. There have been posts made by members who have had to deal with this situation. Search on the forums posts for these members and ask them directly.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

What will happen if she has the baby before the interview? :( How bad can it affect the process? What is an expedite? And how/where do we ask for it?

Forgive me if these questions look stupid to you, but i am honestly new so i am learning.

Child would be registered as a USC at the Consulate.

You have one more mouth to feed as far as the Affidavit of Support is concerned.

I would forget about the expedite, you have no cause.

If I were you I'd do what's customary. If that's getting married before having the baby, I'd get married. There's a chance you could complete a K-1 before baby is due, but baby is in charge now. Focus there.

I was pregnant during our K-1 visa process. Nothing will be different for the 2 of you during the process meaning, no expediting. But the pregnancy does count as evidence of a valid relationship.

Also, BEFORE she goes for her medical, she needs to aquire from her Doctor on official office letter head, a letter stating that she is pregnant, her expected due date, and the Dr.'s signature. She will need this letter to be exempt from the chest x-ray. You will also want to have this letter with you when she/you attend the visa interview.

When your packet 3 comes in the mail, it will have your interview date listed. If it is too close to her delivery date, and she has to fly or travel a long distance call/e-mail the Consulate stating that for her's and the baby's health that she cannot travel safely at that time due to the pregnancy, of which you have a Dr's note to confirm, and if it would be possible to have the interview moved a head a few weeks for the health and safety of the baby.

They may be accomodating to this request but only with Dr. confirmation.

It means that 2 glands were URGENTLY calling out to one another. Doesn't mean there is a bonafide relationship, just that coitus occurred wo/ advanced planning. Men and women have sex all the time, but it doesn't mean love is involved. Just sayin' :whistle:

But Congratz on bringing new life into the world as a result, and good luck in your VJ. Just follow the guides,and provide ample evidence of a love-based relationship. Really....

Thank you all for the advices ... we are trying our best with this. We planned to go with the K1 anyhow, but when the pregnancy question occurred we didnt know for sure if we can still go with this procedure regardless the fact that she will be pregnant. Now i see that we can just move on with our plans and pray that the process itself wont be too long. Thank you for all the help
